City shall not be liable for acts of Contractor in performing services described herein. Insurance. Should the City require evidence of insurability Contractor shall file with City a Certificate of Insurance before commencing any services under this Agreement. Said Certificate shall be subject to the approval of City's Director of Administrative Services. Non-Discrimination. Nodiscrimination shall be made in tl~e employment of persons under this Agreement because of the race, color, national origin, ancestry, religion or sex of such person. Interest of Contractor. It is understood and agreed that th s Agreement is not a contract of employment in the sense that the relation of master and servant exists between City and undersigned. At all times Contractor shall be deemed to be an independent contractor and Contractor is not auth~~rized to bind the City to any contracts or other obligations in executing this Agreement. Contractor certifies that no one who has or will have any financial interest under this Agreement is an officer or employee of City. Changes. This Agreement shall not be assigned or transferred without the written consent of the City. No changes or variations of any kind are authorized without the written consent of the City. HJW GeoSpatial, a 54 year old Oakland, CA firm specializing in aerial photography, photogrammetry, orthophotography, and GIS, is proposing to develop high resolution orthophotograpriy for the City of Cupertino. Proposed Product: HJW proposes to produce black and white orthophoto imagery with a 0.5 foot pixel resolution from new aerial photography to be flown in June of 2004. The orthophoto imagery will be of "engineering" quality with a horizontal accuracy meeting accepted mapping standards for 1"=40' scale mapping. Source Photography: 1:4,800 color stereo photography to be flown in June 2004 Control: Airborne GPS ar~d IMU control supplemented with premarked Sani:a Clara Water District ground control. Elevation Model: Existing supplerented with correlated canopy from new photography Datum: California State Plane Zone 3 NAD 83 Units: Feet Pixel Resolution: 0.5 foot Tile Size: Cupertino's existing layout Horizontal Accuracy: National Map Accuracy Standards for 1"=40' mapping Metadata: FGDC Content ~;tandards for Digital Geospatial Metadata Pilot Submittal: Before preparing the final submittal for the first phase of the project ,HJW GeoSpatial will submit four adjacent tiles for the City's review. The purpose of this submittal is to permit the City to review and comment on a small portion of HJW GeoSpatial's work that rE~presents a sample of all items of work that will be submitted under this proposal. The review of this submittal will provide HJW GeoSpatial feedback from the City before beginning large portions of the final work product. Review of this pilot work will establish standards by which all subsequent delivE~ries will be measured. HJW GeoSpatial shall incorporate the City cornments on this pilot submittal into the preparation of the remainder of the ~Jeliverables. Deliverables: • One (1) set of digital terrain model (DTM) data files at a level of density to support the production of digital orthophotos and the generation of the 2' contours. H.1W wi// deliver this data on/y if there are modifications to the original Cupertino DTM. • One (1) set of digital orthophotos on CD-ROM disks for the specified areas of the City of Cupertino at ~i map accuracy standard of 1"= 40', at a pixel resolution of 0.50 feet. Formats will include JPG, TIFF and MrSID. • One (1) copy of the flight and control plan. • One (1) set of all the field data ar~d derived information, including horizontal and vertical coordinators for all control positions. • One (1) plot of the ground controii points used. • One (1) set of 9"x 9" black and white contact prints of all aerial photography. • One (1) copy of the final analytic~~l aerotriangulation results. • One (1) Report of Calibration of Aerial Mapping Camera • One (1) set of mylar plots, 24" x 36", 1" = 100', using existing Cupertino title block and date of capture. Image quality will be suitable for blueprint reproduction. Background Information Provided bey the City of Cupertino: City of Cupertino orthophotos were flown in June 2000. The project included the entire limits of the City of Cupertino (approximately 10 sq. miles) p/us a minimum of a 1,000 foot perimeter beyond the City limits. The photography was used 1.o develop the control network, the analytical aerotriangulation and the DTN1's -accurate enough for the required orthophotos. However, these elevations are not accurate enough for producing accurate National Map Accuracy Standard contours, etc, for design engineering purposes. A sheet (tile) gri~~ index was established for the City for delivery of the digital orthophotos. Costs HJW will fly the entire limits of the City of Cupertino p/us a minimum of a 1,000 foot perimeter beyond the City limits (as needed), and update 50% of the original tiles using the existing DEM collected in June of 2000. Total costs set forth in this proposal will be fixed.
