HEIGHT EXCEPTION (EXC-2009-09) to allow the antennas to be mounted at a height of 97 and 98 feet on a vertical extension of the PG&E lattice tower where 55 feet is allowed. RECOMMENDATION: Staff recommends approval of the Director's Minor Modification and Height Exception per the model resolutions enclosed. Planning Commission action is final, unless appealed to the City Council. BACKGROUND: The applicant, representing Clearwire, is proposing to install a personal wireless service facility with antennas on top of a six-foot tall vertical extension of an existing 93-foot tall PG&E lattice tower located in the perimeter landscape strip of the northeast corner of a residential condominium complex (See photo below and Attachment 1). Clearwire, a subsidiary of Clearwire Communications and Sprint-Nextel Communications, is proposing to develop a new, high speed, wireless voice and Internet communications network in the San Francisco Bay Area and other parts of the country. The total height of the tower will be 99 feet. However, in this case the proposed minor modification is being considered by the Planning Commission due to the height exception proposal. Location/Setback The Cupertino Wireless Facilities Master Plan prefers personal wireless facilities to be located in non-residential areas. However, if the facility is located in a residential area, the preference is mounting the equipment on existing tall structures, such as a lattice tower. Further, the Cupertino Wireless Facilities Ordinance permits wireless facilities to be mounted on an existing utility pole or tower, regardless of zoning district or setback to a residential property line, as long as the facilities comply with federal exposure standards for radio frequency energy. Since there are no commercial shopping centers or buildings in the project area tall enough to facilitate the height requirement for the proposed wireless antenna mounting, the project proposes mounting the equipment on an existing utility lattice tower. Design/Height The applicant is proposing a "top-hat" design for its facility with the antennas mounted on a 6-foot tall rectangular framework on top of the existing 93-foot tall PG&E lattice tower, bringing the total height of the lattice to 99 feet (6.5% increase in the overall height of the tower). The extra height is needed to avoid the high voltage transmission lines, and to elevate the microwave dish antennas above the surrounding buildings, trees and topography to ensure a clear line of sight to other Clearwire sites. Unlike other wireless communication technologies, Clearwire relies on point-to-point microwave connections with other towers, not wire connections. Historically, the Planning Commission has supported similar applications with comparable height exception requests on lattice towers: 1) Monta Vista PG&E substation at California Oak Way (94 feet tall, file no. EXC-2005-17; 157 and 158 feet tall, file no. EXC-2009-08); 2) PG&E substation at Homestead Road near Stelling Road (94.3' and 85.5 feet tall, file no. EXC-2008-17); and 3) 10655 Mary Avenue lattice tower (148,149 feet tall, file no. EXC-2009-07). Staff supports the project and the height exception request because: Gordon Bell (for Clearwire) DIR-2009-36, EXC-2009-09 January 12, 2010 Page 4 1. The project is consistent with the Wireless Master Plan policy that articulates the use of existing vertical structures when wireless facilities are proposed in residential areas. 2. Proposed rectangular panel antennas visually blend in with the rectangular lattice tower extension. 3. The visibility of the proposed circular microwave dishes is minimized because of the small size of the dishes and their height above ground level. See the photosimulations (Attachment 2). 4. The higher antenna heights are justified because of the microwave communication linkage between Clearwire cell sites. Radio Frequency Energy (RFE) Assessment The applicant has commissioned the preparation of a RFE report prepared by Hammett & Edison, Consulting Engineers (Attachment 3). The report calculated the maximum effective radiated power, the exposure distances at ground level and the closer distances to the upper floors of the multiple-story buildings, which is about 115 feet instead of the 130 feet to grade level. The exposure data was evaluated against the adopted federal exposure standards. The report concluded that the proposed facility will meet the federal safety standards for RFE of 1.0 mW/cm2. The calculated ground level exposure is 0.060% of the applicable public exposure limit, and at any nearby building, 0.095 % of the applicable public exposure limit. Since this project meets the federal safety standard for RFE, Federal Telecommunications Law prohibits local governments from denying such a wireless facility based on the environmental effects of its RFE generation. The attached chart depicts the RFE exposures that are generated by various household devices and compares it to a typical personal wireless service facility (Attachment 4). Equipment Noise The antennas mounted on top of the lattice are noiseless. However, the base equipment does generate a measurable level of noise that was measured and reported by the applicant (Attachment 5). Sound pressure declines as distance from the source increases. At 40 feet from the equipment cabinet, which is the distance to the nearest residential property line, the expected noise level will be about 47dBa. The City nighttime noise standard at a residential property line is 50dBa. The project meets the City noise standard. Public Noticing Staff referred plans to the Cities of Los Altos and Sunnyvale and mailed public hearing notices to property owners owning land within a 1,000-foot radius of the project property. Sunnyvale City staff had no comments (Attachment 6). TECHNOLOGY, INFORMATION AND COMMUNICATION COMMISSION (TICC) COMMENTS: Per Ordinance requirements, TICC provides technical advice to the Planning Commission on personal wireless service facilities. TICC has designated two of its members to review and comment on pending applications. One TIC Commissioner, Peter Friedland, responded (Attachment 8). He supports the project.
