APPROVED PROTECT The approval is based on the arborist report prepared by Arbor Resources dated February 9, 2010 regarding the two Coast Redwoods; and the arborist report prepared by Arborwell Professional Tree Management regarding the eight Monterey Pine trees and two Coast Redwoods dated February 17, 2010 except as may be amended by conditions in this resolution. TREE REPLACEMENTS The applicant shall be required to plant one (1) 36-inch box tree and (18) 24-inch box trees in accordance with the City's Protected Tree Ordinance. At least two replacement trees shall be Coast Redwoods. The replacement trees shall be planted within 60 days of the approval of this application. 3. REVISED TREE REPLACEMENT PLAN The applicant shall submit a revised tree replacement plan prior to the tree removals. Replacement trees shall not be shrubs, and must be planted in the immediate vicinity of the residential buildings. At least three replacement trees shall be planted in the courtyard between 10659 and 10649 Maplewood Road. 4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herei n may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Staff received comments from two community members regarding this project. One expressed concerns regarding the loss of shade that would result from the tree removals. A condition has been added to locate the replacement trees within the immediate vicinity of residential buildings, and to plant replacements on at least a one-for-one basis in the courtyard between 10659 and 10649 Maplewood Road. The other community member expressed concerns about the removals of the two Coast Redwood trees, particularly regarding the accuracy of the applicant's arborist report, whether a third party was consulted, and why no quantitative data was supplied. The City's Consulting Arborist inspected the two Coast Redwood trees and found that the trees in their current location have the potential to cause damage to the adjacent foundations and hardscape because of the lignotuber growth at the base of the trunks. There are no measures that could be employed to reduce the risk of future foundation damage without increasing the risk of the trees uprooting in the future. The Consulting Arborist also found that the trees were more susceptible to falling because of the lack of branches on the lower 25 to 30 feet of their trunks. The concentration of foliage at the upper half of the trunk creates a greater risk of the top breaking (particularly during a storm event) than if the foliage was more uniformly distributed along the entire trunk. City staff concurs with the Consulting Arborist's findings. The City does not require arborist reports to contain quantitative data. Please note, however, that an appeal of this decision can be made within 14 calendar days from the date of this decision. If this happens, you will be notified of a public hearing, which will be scheduled before the Planning Commission and the trees cannot be removed until a final decision on the appeal has been made. If no appeal is made within the appeal period, the trees may be removed after Friday, Apri116, 2010. Additionally, new branches that did grow along the lower trunks would be weakly attached and susceptible to breakage. Regarding the trees' locations, there is the potential for future damage of adjacent foundations and hardscape (although none was observed at this time), and there are no measures that could be employed to reduce this risk to less-than-significant levels without predisposing the trees to uprooting. The distinct large growth at the bases of both trunks is called a"lignotuber" (a natural growth of coast redwoods), and has the capacity to move or damage surrounding foundations and hardscape. The greatest potential for damage to occur is by tree #85, which is only a few feet from the foundation. When considering the above information, it is my opinion that the removal of both trees would conform to Section 14.18.180 of the City Code, provided replacements are installed as mitigation. In my opinion, the replacements (pursuant to Table A of the Code) should include at least four trees of 24-inch box size (two per tree removed} versus one of 36-inch box size based on the lack of trees (both large and small) at the site. Its trunk diameter measures 26 inches at 54 inches above grade, and is about tvvice that size at grade. Surrounding the trunk is a walkway to the north, and wooden fence to the south, east and west. A section of the trunk has grown over the walkway by seven inches, and the trLUik's base abuts the fence to the south and east sides. A laundry room and carport structure is situated six and-otle-half feet north of the trLUlk's base. The disease can also be carried on seeds of infected trees resulting in developing seedlings that are also infected. Death of trees may result from the effects of the disease itself, from infesting insects in weakened trees, or a combination of both. No effective chemical or biological control has yet been developed for pitch canker; therefore, Arborwell recommend� that tllese trees �hould be removed and replaced with non-susceptible species is a good idea. The "shot hole'" appearance of the bark in infested trees indicates beetles have matured, chewed e�it holes and flown off to find new breeding sites. Once bark beetles are established in a tree, they emit pheromones, which attract other beetles to the same tree. Bark beetles usually attack trees that are weakened or dying due to other stress factors such as drought, disease SI110� mechanical injury, etc. They are also attracted to recently cut wood. Once a tree is infected, trees almost never recover and usually die rapidly. Control efforts at this point are futile.
