APPROVED PROTECT � The approval is based on the arborist report prepared by Ron Walker, ISA Certified Arborist #WE-8658A, dated February 2, 2010 pertaining to the Western Sycamore located 10268 Creston Drive, except as may be amended by conditions in this resolution. 2. TREE REPLACEMENTS The applicant shall be required to plant one (1) 36-inch box size Japanese Maple on the property in accordance with the City's Protected Trees Ordinance. The required replacement trees shall be planted within 60 days of the effective approval date of this tree removal permit. 3. IN-LIEU TREE REPLACEMENT FEE In the event a replacement tree cannot be planted on the property as determined by the Director of Community Development, the applicant will be required to pay an in-lieu tree replacement fee based upon the purchase and installation cost of the replacement tree(s) in compliance with the City's Protected Trees ordinance. 4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these TR-2010-11 10268 Creston Drive Page 2 Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Staff has made the findings necessary to grant the tree removal permit in accordance with Section 14.18.180 of the Protected Trees Ordinance. Please note, however, that an appeal of this decision can be made within 14 calendar days from the date of this letter. If this happens, you will be notified of a public hearing, which will be scheduled before the Planning Commission and the tree cannot be removed until a final decision on the appeal has been made. If no appeal is made within the appeal period, the tree may be removed after Monday, Apri126. This report is to advise you about the status of a Sycamore tree in your back yard. Attached to this report are pictures for your easy reference. THE TREE: This tree in question is a Sycamore (Platanus racemosa) and has a trunk diameter of 23-inches measured at 48-inches above soil grade level. Its height is approximately ?0-feet, with has a spread of 60-feet. The tree appears healthy with good vigor and annual shoot growth. THE PROBLEM: This tree is located less than 3-feet from the rear-side wall of your house. At the present time, the tree's trunk is pressing against the gutter of the house. Furthermore, the cement slab that surrounds the tree trunk has uplifted and in some areas by as much as 2-inches. MY PROFESSIONAL OPINION: This tree is in the wrong place for long-term development. As it continues to age, the trunk annually will increase in caliper size causing damage to the edge of the roof. Its roots are even more of a concern to me, considering where the tree is located. Those roots will continue to become more evasive, causing damage to the building foundation. Root pruning is not an option because it would jeopardize the stability of the tree.
