APPROVED PROTECT This approval is based on a plan set entitled, "822 Candlewood Drive, Cupertino, CA; Pre Planning Application Documents;" consisting of five sheets, dated May, 14, 2010, except as may be amended by conditions in this resc�lution. 2. CONSULTATION WITH OTHER DEPAR'I'MENTS The applicant is responsible to consult witll other departments and/or agencies with regard to the proposed project for additional conc_itions and requirements. Any misrepresentation of any submitted data may invalidate an a�proval by the Community Development Department. 3. EXTERIOR BUILDING MATERIALS/TRFATMENTS Final building exterior treatment plan (inc] uding but not limited to details on exterior color, material, architectural treatments and/or E mbellishments) shall be reviewed and approved by the Director of Community Development prior to issuance of building permits. The final building exterior plan shall closely resemb te the details shown on the original approved plans. Any exterior changes determined tc� be substantial by the Director of Community Development shall require a minor modifi :ation approval with neighborhood input. 4. PRIVACY PLANTING The applicant shall provide privacy screening trees or shrubs to block the views from the south side bathroom windows. The buil�ing permit plans shall be revised to show the trees/shrubs and the location of the und�rground utility lines. The final privacy-planting plan shall be reviewed and approved by t:1e Planning Division prior to issuance of building permits. The trees shall be planted before final occupancy. 5. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, arid other exactions. Pursuant to Government Code Section 66020(d) (1), these Condition� constitute written notice of a statement of the amount of such fees, and a description of t�e dedications, reservations, and other exactions. You are hereby further notified that the 90 -day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to iile a protest within this 90-day period complying with all of the requirements of Section 660:'_0, you will be legally barred from later challenging such exactions. Please be aware that if this permit is not used �Nithin one year, it shall expire on June 7, 2011. Staff received comments from a neighbor regarding privacy, health, view, and property value concerns. The neighbor felt that the south side bathroorr windows will create privacy impacts. The applicant has agreed to plant privacy screenin; trees in front of the bathroom windows (condition #4) and obscure the glass with glaz ng material. Additionally, the window sills are five feet above the one-story home's finish floc�r. The neighbor felt that the location of the new t�athroom on the south side of the house would expose them to odors that would adversely irr pact their health. The applicant will be planting trees and will install mechanical ventilation ec� uipment to help alleviate any potential odors. There is no empirical evidence to suggest that having bathroom windows within 11 feet to another house will create health risks. Lastly, the neighbor brought up concerns aboi�t how they felt the extension will block their view to the street and lower their property values. The applicant's proposal meets the required setbacks contained in the R1 Ordinance. There are no further City policies to protect views nor does the City evaluate property values. Staff has made all of the findings that are required for approval of a Minor Residential Permit as required by the of Cupertino's Municipal Cod��, Chapter 19.28.090 (B). Also, please note that an appeal of this decision can be made within 1�E calendar days from the date of this letter. If this happens, you will be notified of a public hearing, which will be scheduled before the Planning Cornmission.
