APPROVED PROTECT The approval is based on the ISA cer afied arborist report prepared by Walter Levison dated 09/02/2010 titled "Assessmen�: of one coast live oak (Quercus agrifolia)" and Sheet A-0, labeled Tree Replacement Plan, dated July 16, 2010, at 7478 Fallenleaf Lane Cupertino, CA, except as may be amer.ded by conditions in this resolution. 2. TREE REPLACEMENTS The applicant shall be required to plar.t or two (2) 24-inch box size Blue Oak "douglasii' on the property in accordance with tr.e City's Protected Trees Ordinance. The required replacement tree shall be planted within 15 days of the effective approval date of this tree removal permit. 3. NOTICE OF FEES, DEDICATIONS, RI;SERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conciitions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. This tree measures 23.5 inches diameter at 4.5 feet a�ove grade. The tree stands approximately 25 feet tall and exhibits an approximate spread of 45 feet diarneter, extending out into the neighboring property behind 7478 Fallenleaf. On scales from zero to 100% each, this tree has a he;alth rating of 20% and a structural rating of 30%, for an overall condition rating of 25% or "Very Poor'. Trees rated 'Very Poor' are usually slated for removal if they in any way hinder proposed site development. b) Proqosed Residence: The proposed residence footprint as shown on sheet ��-0 is no closer than 8 horizontal feet from the trunk edge of the subject oak. Given the size of the tree, thi:� could be considered a significant to severe impact, depending on the type of foundation footing u:;ed. c) Proqosed Foundation: The proposed foundation footing as shown on sheet P, 4.1 will be a perimeter grade beam with T-bottom, requiring excavation down to at least 18 inches below grade, severing much of the subject tree's remaining root system. Again, this could be considere� a significant or a severe impact to the subject tree in a normal situation. However, given that the tree is iri 'Very Poor' condition, the author suggests removing it outright. 2.0 Assignment I was requested to prepare a tree protection plan for tl�e subject oak at 7478 Fallenleaf, Cupertino. However, given the condition of the tree, the author is recommending removal of the tree at this time. Therefore, tree protection measures are inapplicable t� the situation. My findings are summarized above in summary section 1.0 and in observations and discussion section 3.0 below. The site apparently had newly installed landscaping at that tim �, consisting of turf grass (outside the subject tree canopy dripline), bamboos outside the canopy driplin �, and a rock playground equipment pad under the canopy dripline. The bamboos are irrigated via over g tubing and bubblers with no apparent new subgrade piping (good). Moderate to severe oak root severing may have occui•red as a result of rock playground pad installation which encroaches to within 6 horizontal feet of the trunk edge of the subject tree. Given that the new landscaping and irrigation do not ��ppear overly harsh in terms of impacts to the subject tree root system, it is not entirely clear why the tree h��s declined to an overall rating of "Very Poor" (25%). The most likely hypothesis is that decline is directly related to severe overhead high voltage line clearance pruning by PG&E contractors over the years. Tree hea/th and structure The subject exhibits very poor live twig density and e�tension. The subject has been severely pruned in the past to clear high voltage overhead wires as noted above, and the current owners recently had the tree pruned c n their side of the tree to clear their PG&E electrical service drop. Recent pruning involved cuts 2 to 3 inches diameter each. Historical line clearance pruning appears to have involved much larger diameter cuts ��hich allowed too much sunlight into the canopy, causing sunscald cankers on the upper sides of the rrainstems and limbs, and apparently starting a spiral of decline whereby the tree's vascular tissues were cc mpromised (see close-up photo of the cankered area in section 10.0 below). 4.0 Recommendations Since the subject tree has been severely pruned by P�&E crews over the years, and given its very poor live twig density and extension, I do not expect the tre� to recover to any normal health or structural status. Clients may choose to accept or disregard the recommendations of the arborist, or to seek additional advice. Arborists cannot detect every condition that could possibly lead t�� the structural failure of a tree. Tree are living organisms that fail in ways we do not fully understand. Conditions are often hidden withiii trees and below ground. Arborist cannot guarantee that a tree will be healthy or safe under all circumstances, or for a specified period of time. Likewise, remedial treatments, like any medicine, cannot be guaranteed. Treatment, pruning, and removal of trees may involve consider tions beyond the scope of the arborisYs services such as properly boundaries, property ownership, site lines, disputes between neighbors, and other issues.
