Associates, LLP 12280 Saratoga-Sunnyvale Road #209 Saratoga, CA 95070 SUBJECT: RESIDENTIAL DESIGN REVIEW �.CTION LETTER - Application R-2010-24: This letter confirms the decision of the � irector of Community Development, given on November 30, 2010; approving a new 2,681 square foot, two-story, single family residence located at 19021 Meiggs Lane, with the followi ng conditions: 1. APPROVED PROTECT This approval is based on a plan set en itled, "Proposed Chen Residence, 19021 Meiggs Lane, Cupertino, CA 95014," consisting of eight (8) sheets dated July 12, 2010 with a revision date of October 28, 2010; and color and material sheet, except as may be amended by conditions in this resolution. 2. ACCURACY OF THE PROTECT PLANS The applicant/property owner is responsible to verify all pertinent property data including but not limited to property boundary loc ations, building setbacks, property size, building square footage, any relevant easements an3/or construction records. Any misrepresentation of any property data may invalidate this a� �proval and may require additional review. 3. SECOND STORY WINDOW MODIFICAT IONS Prior to issuance of building permits, tt�e construction plans shall reflect the following second story window modifications: a) The two (2) windows shown on thE north elevation in bedroom #3 shall be deleted b) The bathroom #3 window on thE narth elevation sl be made translucent and remain openable c) All three (3) master bathroom v� �indows on the north elevation shall be made translucent. The window in the toil et area shall remain openable; the window next to the sink shall be fixed in place (nc�n-openable); and the window between the toilet area and sink shall be fixed in placE �(non-openable) d) The master bathroom and master bedroom window on the west elevation shall be made translucent Residential Design Review Action Letter Page 2 R-2010-24 4. SECOND STORY WINDOW COVENANT Prior to final occupancy, the property ov�ner shall record a covenant on this property to inform future property owners of the �econd story window restrictions contained in condition #3. The precise language w:ll be subject to approval by the Director of Community Development. Proof of recc�rdation must be submitted to the Community Development Department prior to final oc�,upancy of the residence. 5. OAK TREE PROTECTION As part of the demolition or building � ermit drawings, a tree protection plan shall be prepared by an ISA-certified arborist for i he Oak tree to be retained near Meiggs Lane. In addition, the following measures shall be � dded to the protection plan: a) Chain link fencing and other root ��rotection shall be installed around the dripline of the tree prior to any project site work. b) No parking or vehicle traffic shall l�e allowed under root zones, unless using buffers approved by the Project Arborist. c) No trenching within the critical ro� �t zone area is allowed. If trenching is needed in the vicinity of trees to be retained, the City's consulting arborist shall be consulted before any trenching or root cuttin€; beneath the dripline of the tree. d) Wood chip mulch shall be evenly spread inside the tree projection fence to a four- inch depth. e) Tree protection conditions shall be posted on the tree protection barriers. f) Retained trees shall be watered to r laintain them in good health. g) A covenant on the property shall l�e recorded that identifies all the protected trees, prior to final occupancy. The tree protection measures shall be inspE �cted and approved by the certified arborist prior to issuance of building permits. The City's consulting arborist shall inspect the Oak tree and shall provide reviews prior to issuance of clemolition, grading or building permits. A report ascertaining the good health of the trees m �ntioned above shall be provided prior to issuance of final occupancy. 6. LANDSCAPING PLAN The final landscaping plan shall be reviev��ed and approved by the Plaruling Division prior to issuance of building permits. If the land �caping area is greater than 2,500 square feet, then a full landscape project submittal per sE�ction 14.15.040 is required prior to issuance of building permits. 7. PRIVACY PLANTING =' If privacy planting is required, the fin� 1 privacy-planting plan shall be reviewed and approved by the Planning Division prior i o issuance of building permits. If existing tree(s) is used for privacy screening, a letter from a certified arborist shall be submitted confirming that the tree(s) is in good condition and is �►ppropriate privacy protection in any season. 8. PRIVACY PROTECTION COVENANT If privacy planting is required, the proper .y owner shall record a covenant on this property to inform future property owners of the privacy protection measures and tree protection requirements consistent with the R-1 Ordinance, for all windows with views into Residential Design Review Action Letter Page 3 R-2010-24 neighboring yards and a sill height that is 5 feet or less from the second story finished floor. The precise language will be subject to approval by the Director of Community Development. Proof of recordation mus : be submitted to the Community Development Department prior to final occupancy of the residence. 9. CONSULTATION WITH OTHER DEPAR�CMENTS The applicant is responsible to consult wit:1 other departments and/or agencies with regard to the proposed project for additional conciitions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 10. EXTERIOR BUILDING MATERIALS/TREATMENTS Final building exterior treatment plan (inc .uding but not limited to details on exterior color, material, architectural treatments and/or ��mbellishments) shall be reviewed and approved by the Director of Community Developme nt prior to issuance of building permits. The final building exterior plan shall closely reserr�ble the details shown on the original approved plans. Any exterior changes determined to be substantial by the Director of Community Development shall require a minor modifi�:ation approval with neighborhood input. 11. NOTICE OF FEES, DEDICATIONS, RESEI.VATIONS OR OTHER EXACTIONS The Conditions of Project Approval set f�rth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditio 1s constitute written notice of a statement of the amount of such fees, and a description of �he dedications, reservations, and other exactions. You are hereby further notified that the 9)-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to =ile a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Please be aware that if this permit is not used within two years, it shall expire on November 30, 2012. Staff received comments from two neighbc rs regarding the project. Both neighbors were concerned about loss of privacy resulting frc�m the new two story house. The applicant and property owner worked with both neighbors to modify the second story windows to their satisfaction. The modifications are listed in cor�dition #3. f+ One neighbor brought up additional concerns about the location of the house towards the north property line; the reduction of sunlight resulting from the close proximity of the new house; and the safety of the driveway location. The C'ity's zoning ordinance defines the front property line for corner lots as the shorter lot line abutting a street. In this case, the front property line is the one along Morengo Drive. Therefore, thE house is permitted to face Morengo Drive. The proposed house meets the R1 Ordinance-r� �quired setbacks. The City does not have any regulations for protection of sunlight. The dr: veway is located approximately 45 feet from the intersection of Meiggs Lane and Morengo D�ive and the Public Works Department does not object to its location. The property owner will �e removing the existing corner hedge to improve Residential Design Review Action Letter Page 4 R-2010-24 visibility and pedestrian circulation, and are required to keep the corner triangle area clear of fences and shrubs higher than three (3) feet. [n addition, the existing driveway on the Meiggs Lane side will be removed. Staff has made all the findings that are requir� �d for approval of a Two-story Residential Permit as required by the of Cupertino's Municipal Code, Chapter 19.28.100 (D). Also, please note that an appeal of this decision can be made withi n 14 calendar days from the date of this letter. If this happens, you will be notified of a pub lic hearing, which will be scheduled before the Planning Commission.
