SUBJECT: TREE REMOVAL PERMIT ACTION LETTER — Application TR-2011-29:
This letter confirms the decision of the Director of Community Development, given on June 24, 2011,
approving a tree removal permit to remove and replace five (5) Evergreen Pear trees and one
Sweetgum tree at 20730 Stevens Creek Boulevard with the following conditions:
1. APPROVED PROTECT
The approval is based on the justification statement and tree inventory table within the arborist's
report prepared by Arbor Resources on Apri14, 2011, except as may be amended by conditions in
this resolution.
2. TREE REPLACEMENTS
The applicant shall be required to plant four (4) 24-inch box Pyrus Calleryana and two (2) 36-inch
box London Plane trees on the property in accordance with the City's Protected Tree Ordinance.
The trees shall be planted prior to final occupancy of building permit no.11050115.
3. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of
such fees, and a description of the dedications, reservations, and other exactions. You are hereby
further notified that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If
you fail to file a protest within this 90-day period complying with all of the requirements of
Section 66020, you will be legally barred �fom later challenging such exactions.
Staff has made the findings necessary to grant the tree removal permit in accordance with Section
14.18.180 of the Protected Trees Ordinance.

Dear George,
The project proposes to remove G trees. Please see the attached list of trees information for reference
Below is a list of proposed tree removals and explanation.
Trees #2, 3,4,5,G and, 7 as listed in the April 4, 2011 Arborist Report, line the west side of main vehicle entry
and pedestrian pathway.
The arborist has identified these trees as "Fair" in overall condition and indicated several specific problems
with each tree, including encroaching into the pedestrian pathway.
These trees line the main entrance to the shopping center and are not remarkable in and of themselves. In
addition, the existing root structure of these trees will make it difficult to impossible to plant new understory
plants. These trees work against our efforts to create a strong landscape identity for the site, as well as not
conforming to the Heat of the City f'lan.
We are proposing to plant four 24 gallon Pyrus calleryana and two 3G gallon London Plane trees in their place.
Please the attached plans for the proposed tree locations. The proposed tree replacement will create strong
presence and entry into the shopping center, enable under story planting to thrive, as well as set up the
precedent for future development of the east side of the drive entry. This will create a distinct and elegant
design reinforcing the Heart of the City Plan.
