LETTER AGREEMENT
between
Alex Tsai and the City of Cupertino
Concrete Retaining Wa11 at Blackberry Farm
This Letter Agreement formally establishes points of agreement between Alex Tsai, hereinafter referred to as
Resident, and the City of Cupertino, hereinafter referred to as City, regarding the construction of a concrete
retaining wall at the Black Berry Farm maintenance yard. This connection concept was discussed and
informally agreed to by both City and Resident several years earlier when City contributed funding to
Resident's retaining wall.
1. Resident agrees that City may construct the new concrete retaining wall in accordance with the design
documents, attached for reference, which were prepared by City's structural engineer, AKH (Tim
Hyde) and made a part of the Bid Documents for the Blackberry Farm Infrastructure Upgrade project.
2. Resident further agrees to allow the retaining wall to encroach onto Resident's property approximately
ten (10) inches to enable the wall to be physically connected to Resident's existing concrete retaining
wall.
3. Resident further agrees that the City's new concrete retaining wall will be allowed to be physically
connected to Resident's existing concrete retaining wall by use of steel dowels, as shown on City's
structural documents. Resident and City both agree that this connection is mutually beneficial because
it allows the City's new retaining wall to be constructed without disrupting Resident's retaining wall
"end wall pier ". This "end wall pier" is structurally essential to the end wall of both the Resident's and
City's retaining walls.
4. Both City and Resident agree that a physical :onnection of the two retaining walls will also prevent
erosion of both Resident's and City's property, both of which are immediately behind the retaining
connection point.
