APPROVED PROTECT This approval is based on a plan set entitled, "New Addition and Remodel for Single Family Residence: Loh Residence, 19144 Meiggs Lane, Cupertino, CA 95014" consisting of ten sheets, dated July 18, 2011, except as may be amended by conditions in this resolution. 2. PLAN SET REVISIONS Building plan sets shall contain the following revisions: Sheet A0.0: a. Trees: Indicate that no trees are proposed for removal. b. Impervious Area Calculation: Please visually identify the impervious surface area in the front yard area. The maximum allowed impervious surface area for the front yard area is 40%. c. Air Conditioning Unit: If an A/C unit is proposed, please include the location on the site plan. The unit may not be closer than 3' to any property line, may not be in any easement area, and must be properly screened if it is visible from the public right-of- way. d. Fence: Indicate if the fence on the existing site plan will remain or be removed on the proposed site plan, and distinguish the fence with a different line style. Fences are limited to 3' in height in the front yard area, and 6' in height in rear and side yard setback areas. No portion of a fence shall extend into the forty-foot corner triangle. Sheet A3.1: e. Building Envelope: Please label the 25° roof line angle, and remove references to "Plate" next to the 10' high vertical line on the front and rear elevations. Sheet A4.0: f. Finished Floor: Please revise the location of the finished floor on the right under 'Living Sectiori . 3. CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible to consult with other departments and/or agencies with regard to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 4. EXTERIOR BUILDING MATERIALS f TREATMENTS Final building exterior treatment plan (including but not limited to details on exterior color, material, architectural treatments and/ or embellishments) shall be reviewed and approved by the Director of Community Development prior to issuance of building permits. The final building exterior plan shall closely resemble the details shown on the original approved plans. Any exterior changes determined to be substantial by the Director of Community Development shall require a minor modification approval with neighborhood input. 5. ACCURACY OF THE PROTECT PLANS The applicant/ property owner is responsible to verify all pertinent property data including but not limited to property boundary locations, building setbacks, property size, building square footage, any relevant easements and/or construction records. Any misrepresentation of any property data may invalidate this approval and may require additional review. 6. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Staff has received a comment from a neighbor regarding the location of the addition: whether or not it was encroaching onto adjacent properties. The home addition is located wholly on one lot owned by the property owner and is allowed to encroach into current rear yard setback areas with a Minor Residential Permit, subject to the Single Faxnily Residential Ordinance, which this project complies with. Please be aware that if this permit is not used within one year, it shall expire on October 3, 2012. Staff has made all of the findings that are required for approval of a Minor Residential Permit as required by Cupertino's Municipal Code, Section 19.28.090 (B), Ordinance No. 2039. Also, please note that an appeal of this decision can be made within 14 calendar days from the date of the decision.
