APPROVED PROJECT This approval is based on the arborist report prepared by Dave Muffly (Certified Master Arborist WE-4279B), dated October 26, 2011, consisting of 6 pages and entitled: Arborist Report-18920-18922 Forge Drive, except as may be amended by conditions in this resolution. 2. TREE REPLACEMENT The applicant shall plant two (2) 24-inch box Chinese Elm trees on the property in accordance with the City's Protected Tree Ordinance. The required replacement trees shall be planted within 30 days of the effective approval date of this tree removal permit. 3. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Staff has made the findings necessary to grant the tree removal permit in accordance with Section 14.18.180 of the Protected Trees Ordinance. Please note, however, that an appeal of this decision can be made within 14 calendar days from the date of the mailing of this decision. If this happens, you will be notified of a public hearing, which will be scheduled before the Planning Commission and the trees cannot be removed until a final decision on the appeal has been made. Existing trees may be impacted to meet these ADA requirements at two locations. This report includes a survey of all trees surrounding the building undergoing tenant improvements, and includes an analysis of finro trees recommended for removal. This report is separate from a previous tree report and removal application already submitted. Trees #217 and #218 are sweetgums (Liquidambar styraciflua) located adjacent to parking stalls to be demolished at 18920 Forge Drive (see Figures 1, 2& 3). The trees measure 6.1 & 6.9 inches at 4.5 feet above grade. They stand approximately 34 feet in height with a total canopy spread of 14 feet. On a scale from zero to 100% each, the subject trees rate out with a health rating of 70% and a structural rating of 50%, for an overall condition rating of 60% or "Fair". The trees exhibit surface rooting and "sweep root" girdling due to one of the trees being installed with a twisting motion. Both trees reside directly behind an existing concrete walkway and retaining curb. Due to City comments, additional ADA stalls are required to be located in front of the trees. Due to the required depth of these stalls and the required walkway behind them, the proposed accessibility improvements encroach the trunk lines of the trees with a new required 4'-wide sidewalk. Based on the accessibility requirements for these stalls and their proximity to the building entrance, this is the most feasible location for the stalls. Because the removal location has available landscaping, we are proposing to replant two new trees in roughly the same location as those being removed. The proposed replacement species is the semi-evergreen Chinese Elm (Ulmus parvifolia 'Drake' or'Sempervirens'). These trees are long-proven in the Cupertino area in just this kind of setting. The trees create a low-maintenance canopy, and thrive in areas of root confinement and limited supplemental irrigation. This will be a small version of what you can see in the main outdoor seating area at Stanford University's Tressider Union. Please see Figure 3 for further description of this species.
