APPROVED PROTECT The approval is based on the arborist's report prepared by Lewis Tree Service, entitled, "Cupertino Village HOA;' dated November 29, 2011 and the arborist confirmation by Michael Bench, Consulting Arborist, except as may be amended by conditions in this resolution. 2. TREE REPLACEMENTS The applicant will be required to plant iwo (2) Western Redbud, two (2) Tristania Laurina, (2) Chinese Pistache, and two (2) Crape Myrtle trees on the property in accordance with the Protected Tree Ordinance and the approved replacement plan. The replacements shall be planted within 30 days of this permit. 3. NOTICE OF FEES,DEDICATIONS,RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Staff has made the findings necessary to grant the tree removal permit in accordance with Section 14.18.180 of the Protected Trees Ordinance. Please note, however, that an appeal of this decision can be made within 14 calendar days from the date of the mailing of this decision. If this happens,you will be notified of a public hearing,which will be scheduled before the Planning Commission. If no appeal is made within the appeal period,the trees may be removed beginning Friday,January 20,2012. I am in complete agreement that these trees, both the 2 American sweet gum (Liquidambar styraciflua) specimens and the 8 Italian cypress (Cupressus sempervirens) specimens, should be replaced. If they were preserved, the damage would only increase. The recommended Crape myrtle (Lagerstromia indica) species is a good replacement for these locationws, as it does create infrastructure damage unless it becomes very, very old and large. I have not seen any in the south bay large enough to cause damage. I have seen some, which I learned were at least 40-50 years old, and which have not damaged the adjacent paving, curb or gutter in San Jose. Because 10 trees would be removed, I think it is very reasonable to require that they be replaced with 8 - 24 inch boxed specimens. The two Liquidambar trees that are being requested for removal are located, 1.) Between 10194-10192 Parish Place and 2.) 10182-10174 Parish Place. Both trees are between the driveways of the units and are causing damage to the driveways from surface roots. Also there are utilities power, gas, water, ect. In these locations and is a matter of time before roots begin to interfere with the utilities. They are in very poor locations and need to be removed before they cause more damage. There are also two groups of Italian Cypress, requested for removal, 1.)
