Subject: Consider appointing two Council Members to serve on a committee to review a
potential Development Agreement with the Toll Bros.
Recommendation:
Staff recommends the Council appoint two council members to sit on a committee with the staff to
negotiate a development agreement with the applicant, should the applicant decide to pursue that option.
Back~round•
The Toll Bros. are preparing applications for development approvals for the 26 acre Hewlett Packard
property located at the North West corner of Stevens Creek Boulevard and Tantau Avenue adjacent to
Vallco Fashion Park. The development application contains significant residential and commercial
components that may take several years to complete. Consequently, the applicant is considering entering
into a development agreement with the City to ensure their ability to complete the development in a timely
manner.
The City has previously entered into development agreements with Vallco Fashion Park and Hewlett
Packard regarding similarly complex development applications with extended development phases.
Discussion•
In the past, the City formed a committee of the Council and staff to work with the applicant to identify
major issues and points of the potential development agreements. Once the agreement is worked
through the committee process it will go to the full Council for review and adoption.
It is possible the applicant may choose to not pursue a development agreement but staff felt it was
appropriate for the Council to appoint two members that could sit on a committee with staff members to
represent the City's interests if the applicant chooses to pursue such an agreement at this time.
