Contractor agrees to save and hold harmless the City, its officers, agents and employees fro y agNIWDability due to negligence, errors and omissions, including all costs of defending any claim, caused by or arising out of the performance of this Agreement. City shall not be liable for acts of Contractor in performing services described herein. Insurance. Shoulcl the City require evidence of insurability, Contractor shall file with City a Certificate of Insurance before commencing any services under this Agreement. Said Certificate shall be subject to the approval of City's Director of Administrative Services. Non-Discrimination. No discrimination shall be made in the employment of persons under this Agreement because of the race, color, national origin, ancestry, religion or sex of such person. Interest of Contractor. It Is understood and agreed that this Agreement is not a contract of employment in the sense that the relationship of master and servant exists between City and undersigned. At all times, Contractor shall be deemed to be an Independent contractor and Contractor is not authorized to bind the City to any contracts or other obligations in executing this agreement. Contractor certifies that no one who has or will have any financial interest under this Agreement is an officer or employee of City. Changes. This Agreement shall not be assigned or transferred without the written consent of the City. No changes or variations of any kind are authorized without the written consent of the City. Site Model: The site model would be built at 1 :500 scale and would measure approximately 55 by 12 inches. At this scale the bridge towers would measure approximately 1 5/8 inches, with the full slab to slab of the bridge around 13 inches long. Essentially a flat site with berms for the bridge ramps. Sidewalks would be raised. Context would include approximately 25 houses, small portions of the school and storage facility, and highway 280. We would show any of the important sound walls and access fencing. The context would be shown in very muted colors, with landscaping and architectural detailing very simplified. The bridge and project landscaping would be shown in full color, and a higher level of detail. On the bridge, this would include the towers, stay cables, and very simplified railings. We would include cars for scale. Bridge Model: Built at 1 :128 (same as 3/32 inch) scale. The tower height and bridge length would be 6.4 and 52 inches for the 1: 128. This would allow a good amount of detail on the bridge model. This would include the bridge from slab to slab, and just a few inches to each side. The freeway would be shown at a low detail level. Bridge details would include fully modeled towers, all cable stays, road profiles, and detailed railings. We would photo etch the mesh, along with truss post details and the bird and reed art work. This model would include several pedestrians and bicyclists for scale. Costs: The combined model would cost $22,240. This is based on our being given an anotated aerial photo for the streets and context buildings, and also that the landscaping (as yet undefined) will be simpler than the earlier plans I had. Cost as Described $22,240.00 Terms 40% retainer, net 30 Taxable Yes Date Due Agreement The Quote described above is based on information received as of this date. This Quote is void after 30 days, or if there are changes to the size and scope of the project. Sales tax and shipping charges will be added where applicable.
