APPROVED PROTECT The approval is based on an aerial photo and arborist letter prepared by Bill's Tree Care& Landscape,Inc. dated December 2,2011, except as may be amended by conditions in this resolution. 2. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements. Staff has made the findings necessary to grant the retroactive tree removal permit in accordance with Section 14.18.120 of the Protected Trees Ordinance with respect to hazardous conditions created for improvements. These electrical boxes will power the cell tower that will be constructed in a nearby location. The plans don't show a direct impact with this tree, however, I feel that this tree should be removed prior to construction. The issue is in regard to the high maintenance cost and damage potential. This variety of Pine trees is very messy and drops very large and heavy pine cones. 1"hese cones have already caused damage to the rooftop tiles. The risk is that if the electrical boxes are installed at the base of this tree, falling debris and pine cones will cause heightened maintenance costs and expose the unit to continual damage. This damage could result in repeated repair expenses. This area of Cupertino can be an area of high wind speed that increases the risk of tree and limb failures. The increased wind speed increases the potential for failure. If a branch, limb or entire tree where to fail and land on the electrical boxes, the damage and danger to surrounding properties could be significant. My recommendation would be to remove this tree completely prior to the start of construction. Removal of this tree will minimize the potential for damage to the units.
