SUBJECT: RETROACTIVE TREE REMOVAL PERMIT ACTION LETTER- Application TR-2011-46:
This letter confirms the decision of the Director of Community Development, given on January 9, 2012,
approving a retroactive tree removal permit to allow the replacement of two (2) dead Monterey Pines
at 20875 Valley Green Drive, (Villages at Cupertino),with the following conditions:
1. APPROVED PROTECT
The approval is based on a site plan and arborist letter prepared by Commercial Tree Care dated
August 19,2011, except as may be amended by conditions in this resolution.
2. TREE REPLACEMENT
The applicant shall plant two Coastal Redwoods in accordance with the City's Protected Trees
Ordinance. The required replacement trees shall be planted within 60 days of the effective
approval date of this tree removal permit.
3. PROTECTED TREE COVENANT
The applicant shall be required to record a covenant recording the replacement tree as a protected
tree within 30 days of planting the replacement tree in accordance with the City's Protected Trees
Ordinance. Failure to do so may result in code enforcement and/or administrative citations.
4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements. .
Staff has made the findings necessary to grant the retroactive tree removal permit in accordance with
Section 14.18.120 of the Protected Trees Ordinance.

Note: The 2 Monterey Pines at these addressed are dead and should be considered hazardous.
Older Monterey Pine trees are most vulnerable to
a disease called Pitch Canker as well as boring insects called Turpentine Beetle.
Most likely the combination of the two caused these trees to die.
It is recommended to remove this trees for safe .
