Sincerely, George Schroeder Assistant Planner City of Cupertino Enclosures: Resolution Nos. 309 and 310 CC:Byer Properties,Attn:Raissa Young,66 Portero Ave,San Francisco CA 94103 EXC-2011-14 CITY OF CUPERTINO 10300 Torre Avenue Cupertino,California 95014 RESOLUTION NO.310 OF THE DESIGN REVIEW COMMITTEE OF THE CITY OF CUPERTINO TO ALLOW THE RELOCATION OF AN EXISTING LANDMARK SIGN AT THE CROSSROADS SHOPPING CENTER LOCATED AT 20568-20840 STEVENS CREEK BOULEVARD SECTION I: PROTECT DESCRIPTION Application No.: EXC-2011-14 Applicant: Mark Creedon(Byer Properties) Location: 20568-20840 Stevens Creek Boulevard SECTION II: FINDINGS WHEREAS, the Design Review Committee of the City of Cupertino received a Sign Exception application to allow the relocation of an existing landmark sign at the Crossroads Shopping Center located at 20568-20840 Stevens Creek Boulevard. WHEREAS,the Design Review Committee finds that: 1. The literal enforcement of the provisions in Chapter 19.104 of the Cupertino Municipal Code will result in restrictions inconsistent with the spirit and intent of this title; The relocation of the landmark sign is consistent with the intent of the Sign Ordinance in that it will be in a location that does not obstruct visibility, ADA accessibility, circulation, or the Heart of the City landscape easement. The new location of the sign will help enhance the entry into the shopping center and provide adequate visibility for tenants. 2. The granting of an exception will not result in a condition which is materially detrimental to public health, safety,or welfare;and The relocation of the existing landmark sign will not result in a condition materially detrimental to public health, safety, or welfare. In fact, the relocation will improve safety by being located outside of a sidewalk sight triangle. 3. The exception to be granted is one that will require the least modification of the prescribed regulations and the minimum variance that will accomplish the purpose The size and height of the landmark sign is not being increased. In addition, it will be located where it does not obstruct sight triangles and the future location of Building Pad E and its associated walkways. NOW,THEREFORE,BE IT RESOLVED: That after careful consideration of maps,facts, exhibits, testimony and other evidence submitted in this matter, the Application No. EXC-2011-14,is hereby approved;and That the subconclusions upon which the findings and conditions specified in this Resolution are based and contained in the public hearing record concerning Application EXC-2011-14 as set forth in the Minutes of the Design Review Committee Meeting of January 19,2012,and are incorporated by reference herein. SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT. 1. APPROVED EXHIBITS Approval is based on the master sign program criteria dated December 21, 2011 consisting of nine pages Resolution No. 310 EXC-2011-14 January 19,2012 Page 2 prepared by Kahn Design Associates entitled, "Master Sign Program for'The Crossroads';" the sign program consisting of 19 sheets labeled Signage Matrix,Exhibits A-0,A-1,A-2,A-3,B-0.1,B-0,B-1,B-2,B-3,C,D,1,2,3, 4, 5, 6, and 7, prepared by Kahn Design Associates entitled, "The Crossroads, 20568-20840 Stevens Creek Boulevard, Master Sign Program;' and the addendum to the sign program consisting of six sheets labeled Addendums 1, 2, 3, 5, B-1, and B-2, prepared by Kahn Design Associates entitled, "The Crossroads, 20568- 20840 Stevens Creek Boulevard, Addendum to the Master Sign Program," except as may be amended by conditions in this resolution. 2. CONCURRENT APPROVAL CONDITIONS The conditions of approval contained in file no.5-2011-05 shall be applicable to this approval. 3. EXCEPTION APPROVAL Exception approval is hereby granted to relocate the existing "Cupertino Crossroads" landmark sign approxunately 38 feet in the westerly direction to the median planter at the Bandley Drive entrance into the Crossroads Shopping Center.In addition,minor modifications to the landmark sign as shown in the approved sign program are also permitted. 4. BUILDING AND SIGN PERMITS Building/sign permits shall be obtained prior to sign relocation and modification. Sign permits shall be consistent with the approved sign program. The building permit plans shall demonstrate that the sign dimensions (including distance between the pylon legs) are not being modified and that the sign is not being rebuilt. The final colors and materials of the sign shall be reviewed and approved by the Director of Community Development prior to issuance of building permits. 5. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020,you will be legally barred from later challenging such exactions.
