Re: Consider an appeal of the Planning Commission approval of Application TM-
2004-10 for a tentative map to subdivide a 23,158 square foot parcel into two
parcels (approximately 11,000 and 12,000 square feet respectively), and denial of
Application TR-2004-09, regarding potential tree removal of one deodar cedar on
a residential parcel, Cupertino Estates, LLC, 22291 Cupertino Road, APN 326-
16-017.
Dear Mr. Lam:
At its regular meeting of January 4, 2005, the City Council denied the appeal and upheld
the Planning Commission decision. Please call the Community Development Department
at 777~3008 if you have any questions.
Any interested person, including the applicant, prior to seeking judicial review of the
city council's decision in this matter, must first file a petition for reconsideration with
the city clerk within ten days after the council's decision. Any petition so filed must
comply with municipal ordinance code ~2.08.096.

This letter confirms the decision of the Planning Commission! given at the
meeting of November 9! 2004! approving a Tentative Map (TM-2004-10) to
subdivide a 23!158 net square foot parcel into two parcels of approximately 11000
and 12!000 square feet and a denying a Tree Removal (TR-2004-09) to remove
five specimen size trees! located at 22291 Cupertino Road! according to Planning
Conunission Resolutions No. 6282 and 6283.
Please be aware that if the Tentative Map permit is not used within a three-year
period! it shall expire on November 9! 2007.
Also! please note that an appeal of this decision can be made within 14 calendar
days from the date of this letter. If this happens! you will be notified of a public
hearing! which will be scheduled before the City CounciL

OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO DENYING A
REQUEST TO REMOVE FIVE SPECIMEN SIZE TREES: ONE COAST LIVE OAK,
THREE BLUE ATLAS CEDARS AND ONE DEODAR CEDAR

SECTION II: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application
to removal five specimen size trees, as described in this Resolution; and
WHEREAS, the Planning Commission finds:
A. That the tree is not irreversibly diseased, is not in danger of falling, does not
cause potential damage to existing or proposed essential structures, or does not
interferes with private on-site utility services;
B. That there are alternative site development plans that can avoid the cedar trees
and retain them on the property.
C. That the Coast Live Oak is young enough to be transplanted elsewhere on the
property.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence
submitted in this matter, application for Tree Removal is hereby not approved; and
That the subconclusions upon which the findings and conditions specified in this
Resolution are based and contained in the Public Hearing record concerning
Resolution No. 6283
