SUBJECT: PLANNING COMMISSION ACTION LETTER - TR-2003-04
This letter confirms the decision of the Planning Commission, given at the meeting on
June 9, 2003, approving a request to remove two Pine trees and replace them with three
24-inch box London Plane trees in the common area of the Westmont Park Villas, a
residential planned development located at the southwest corner of McClellan Road
and Bubb Road, according to Planning Commission Resolution No. 6193.
Please note that an appeal of this decision can be made within 14 calendar days. If this
happens, you will be notified of a public hearing that will be scheduled before the City
Council.

REQUEST TO REMOVE TWO PINE TREES AND REPLACE THEM WITH THREE 24-

SECTION II: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application
to remove two pine trees: a Bishop Pine and a Monterey Pin and replace it with other
trees, as described in this Resolution; and
WHEREAS, the applicant has met the burden of proof required to support removal of
two of the trees and has satisfied the following requirement:
1) The pine trees, due to structural formation, are unsuitable for retention and will
pose a future hazard to improvements.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence
submitted in this matter, application for Tree Removal is hereby approved as modified;
and
That the subconclusions upon which the findings and conditions specified in this
Resolution are based and contained in the Public Hearing record concerning
Application TR-2003-04, as set forth in the Minutes of the Planning Commission
Meeting of June 9, 2003 are incorporated by reference herein.

1. APPROVAL ACTION
One Bishop Pine and one Monterey Pine, noted as Trees No.1 & 2 on the Arborist
Letter and Tree Locator Map prepared by William E. Jauch of Common Ground
Landscape Management, Inc., dated May 13, 2003, are hereby authorized for
removal. Three, 24-inch box London Plane Trees shall be planted in the common
area as replacements.
PASSED AND ADOPTED this 9th day of June 2003, at a Regular Meeting of the
Planning Commission of the City of Cupertino by the following roll call vote:
