Also, please note that an appeal of this decision can be made within 14 calendar days. If this happens, you will be notified of a public hearing which will be scheduled before the City Council. SECTION I: PROTECT DESCRIPTION Application No.: Applicant: Location: TR-2002-01 Mark Osborne, Cupertino Plaza Prof. Bldg. 20245 Stevens Creek Boulevard SECTION II: FINDINGS WHEREAS, the Planning Commission of the City of Cupertino received an application to removal one Pear (Pyrus communis) tree and replace it with other trees, as described in this Resolution; and WHEREAS, the applicant has met the burden of proof required to support removal of Tree#l; and has satisfied the following requirements: 1) Tree#l, due to structural damage, poor health, and crowding of adjacent healthier trees, is unsuitable for retention. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, application for Tree Removal at Cupertino Plaza Professional Building is hereby approved; and That the subconclusions upon which the findings and conditions specified in this Resolution are based and contained in the Public Hearing record concerning Application TR-2002-01, as set forth in the Minutes of the Planning Commission Meeting of April 8, 2002 are incorporated by reference herein. Resolution No. 6130 Page 2 TR-2002-01 04jOSj02 SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT. 1. APPROVED EXHIBITS: Approval for the removal of Tree#l; one 11-1j 4 inch Pear (Pyrus communis) tree (Tree#l) from the Stevens Creek Boulevard frontage as indicated in the plan set dated March 26, 2002 is granted. 2. REPLACEMENT TREES: Three (3) Bradford Pear (Pyrus Callyerana) 36-inch box trees shall be planted on the subject site in the landscape strip along the north property wall as shown on the plans dated March 26, 2002. The tree drip lines shall be located away from the building. The applicant will be held responsible for the removal and replacement of Tree#l. The replacement trees shall be planted within thirty (30) days of the removal of Tree#l. 3. TREE MAINTENANCE Future pruning andj or maintenance of trees on the site shall be done by an ISA certified arborist.
