SUBJECT: PLANNING COMMISSION ACTION LETTER - TR-2002-06
This letter confirms the decision of the Planning Commission, given at the meeting on
September 23, 2002, approving a Director's Minor Modification with a referral to the
Planning Commission to remove three plum trees and one dead pine tree and replace
them with four Chinese Tallow trees located at 10181 Finch Avenue, according to
Planning Commission Resolution No. 6159. The pine tree replacement must be a larger
24-inch boxed Chinese TaHow.
Please note that an appeal of this decision can be made within 14 calendar days. If this
happens, you will be notified of a public hearing that will be scheduled before the City
Council.

REQUEST TO REMOVE THREE PLUM TREES AND ONE PINE TREE AND
REPLACING THEM WITH FOUR CHINESE TALLOW TREES AT AN EXISTING
CHURCH AT 101S1 FINCH AVENUE

SECTION II: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application
to remove three plum trees and one dead pine tree, as described in this Resolution; and
WHEREAS, the applicant has met the burden of proof required to support removal of the trees.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence
submitted in this matter, application for Tree Removal at Bethel Lutheran Church.
Building is hereby approved; and
That the subconclusions upon which the findings and conditions specified in this
Resolution are based and contained in the Public Hearing record concerning
Application TR-2002-06, as set forth in the Minutes of the Planning Commission
Meeting of September 23, 2002 are incorporated by reference herein.

SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY
DEVELOPMENT DEPT.
1. APPROVED EXHIBITS:
Approval for the removal of four trees as depicted in a site plan titled: Bethel Lutheran
Church" .
2. REPLACEMENT TREES:
Three (3) 15-gallon Chinese Tallow trees shall be planted to replace the plums. One
24-inch boxed Chinese Tallow shall be planted to replace the dead pine tree.
