The application is approved with the following conditions: 1. APPROVED PROTECT This approval is based on the arborist peer report prepared by Michael Bench, dated April 9, 2012, consisting of 2 pages, an arborist report prepared by Gil Mitchell, dated February 14, 2012, consisting of 1 page with attached photos, and a tree removal and tree replacement site plan, except as may be amended by conditions in this resolution. 2. TREE REPLACEMENTS The applicant will be required to plant two (2) 24" box replacement trees in accordance with the Protected Tree Ordinance, the arborist report prepared by Michael Bench, and the approved tree replacement plan. The replacement trees shall be planted within 30 days of the effective approval date of this tree removal permit. 3. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Staff has made the findings necessary to grant the tree removal permit in accordance with Section 14.18.180 of the Protected Trees Ordinance. Please note, however, that an appeal of this decision can be made within 14 calendar days from the date of the mailing of this decision. If this happens, you will be notified of a public hearing, which will be scheduled before the Planning Commission and the trees cannot be removed until a final decision on the appeal has been made. The descriptions of these trees prepared by Mr. Gil Mitchell, ISA Certified Arborist, is very accurate. The two species recommended by Mr. Mitchell are crape myrtle (Lagerstromia indica) and swamp myrtle (Tristania laurina), which has been renamed Tristaniopsis laurina. Both of these require full sun. Either of these two species would be excellent small tree replacements for the dying Southern Magnolia(Magnolia grandiflora) Tree # 7. However, I disagree with the choice of these two species as replacement specimens. The area where Tree # 10 exists is in almost all shade. For this location, I recommend: Cornus kousa(western dogwood) Parrotia persica Stewartia monadelpha Stewartia pseudocamellia Davidia invducrata (Dove Tree) Ilex aquafolium (English holly) Azara microphylla Acer circinatum (Vine Maple) Acer palmatum Bloodgood' or `Sherwood Flame' (Red Japanese maple) Bear in mind that Trees # 11 and 12 are the same species as Tree # 10, fern pine (Podocarpus gracilior). This species was listed as a large shrub in many publications for many years. They were often planted adjacent to buildings so soften the architecture, not realizing that they would eventually become trees of significant size. It was also not known that their aggressive root systems would damage sidewalks and other structures. Trees # 11 and 12 have not lifted the adjacent concrete pathway, but they can be fully expected to do so in the near future. At this location, their canopies loom above the roof line of the adjacent building. Their usefulness as a large shrub to soften the architecture no longer exists. If these two trees are preserved, their shade will likely hinder the growth of the replacement tree at the site of Tree# 10. Tree # 10 is in partial shade by the building, but Trees# 11 and #12 increase the shading ever further. I suggest consideration be given to removal and replacement of Trees# 11 and 12 for three reasons: (1) the shade from these trees will hinder the growth of a new replacement at the location of Tree# 10; (2) the root systems will likely be lifting the adjacent concrete pathway in the near future; (3) the replacement of Tree# 10 alone would not be very effective because of the competition both for light but the competition for moisture and nutrients as well. The replacement trees adapted for partial shade listed above would be appropriate species to replace Trees # 11 and 12. Tree# 11 has a trunk diameter of approximately 13 inches DBH. Tree# 12 has a trunk diameter of approximately 11 inches. Bear in mind that these trees adapted for shade require a very wide planting hole (at least 3 times the nursery container; for example, a 24 inch box tree, should have a planting hole at least 6 feet wide). They should be planted at least 6 inches above the existing soil grade. The soil needs to be rich in organic compost (15%to 25% by volume). Each tree must be well irrigated, especially during the establishment period. Permanent irrigation will be required. It would be essential that each tree have fast drainage.
