Cupertino, Ca 95014 SUBJECT: TREE REMOVAL PERMIT ACTION LETTER - Application TR-2012-31 This letter confirms the decision of the Director of Community Development, given on August 30, 2012, approving a tree removal permit to allow the removal and replacement of a 28" diameter Monterey Pine tree located in the common area of a Planned Single Family Cluster Zone (Meadows of Cupertino HOA) at 10072 Scenic Boulevard. The application is approved with the following conditions: 1. APPROVED PROTECT This approval is based on the arborist peer report prepared by Saratoga Tree Service, dated April 15, 2012, consisting of 2 pages and a tree removal and replacement site plan, except as may be amended by conditions in this resolution. 2. TREE REPLACEMENTS The applicant will be required to plant two (2) 24" box replacement trees in accordance with the Protected Tree Ordinance, and approved replacement plan. The replacement sha 11 be planted within 30 days of the effective approval date of this tree removal permit. The applicant is encouraged to coordinate with neighbors to ensure the safe and timely removal of the subject tree. 3. PROTECTED TREE COVENANT The applicant shall be required to record a covenant recording the replacement trees as protected trees within 30 days of planting the replacement trees in accordance with the City's Protected Trees Ordinance. Failure to do so may result in code enforcement and/or administrative citations. 4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Staff has made the findings necessary to grant the tree removal permit in accordance with Section 14.18.180 of the Protected Trees Ordinance. Please note, however, that an appeal of this decision can be made within 14 calendar days from the date of the mailing of this decision. If this happens, you will be notified of a public hearing, which will be scheduled before the Planning Commission and the trees cannot be removed until a final decision on the appeal has been made. If no appeal is made within the appeal period, the tree(s) may be removed after Thursday, September 13,2012. ' " �� �� - ---- „. . . ..� .r RE: Requested Tree Removals v Saratoga Tree Service was requested by Sharon Armstrong on April 13th, 2012 to provide an arborist report for six trees that the association is reviewing for removal. These trees are all in the common areas of the property. 1. Bradford Pear(Pvrus calleryana)—this large, leaning tree is located inside the pool area by the gate. The circumference at 4.Sft.is 76 inches. The trunk tapers in at the base on the lean side. The tree is healthy(some fireblight may be present). The removal of the tree is requested because the root system is now lifting the concrete azound the pool, creating a trip hazard. The concrete pads are very close to the trunk of the tree (between 19 inches and 7 inches) so root cutting is not an option. 2. Bradford Pear—this is a smaller tree growing on the fence line within the pool area. The tree is 35 inches in circumference at 4.Sft.and is healthy. The trunk is only '/z inch from the fence at this time. There appears to be no lifting of the concrete from the roots of this tree at this time. The removal of the tree is requested because of its' proximity to the fence line. 3. Bradford Pear—this is a third, larger tree growing on the fence line inside the pool area. The circumference at 4.Sft.is 72 inches. The tree is healthy although there may be some fireblight present. The base of the trunk has grown into the fence structure and there is lifting and cracking of the concrete slabs near the tree and the pool edge. The removal has been requested due to concerns about the damage to the concrete and the fence. 4. Bradford Pear—the fourth large Pear is also growing along the fence line within the pool area(it is growing close to a Camphor). The tree is 53 inches in circumference at 4.Sft. The tree is healthy. The trunk tapers in at the base and the tree is growing very close to the fence line. Although there is root material growing over the concrete, there appears to be no lifting or cracking of the concrete near the tree at this time. The removal of the tree has been requested due to the proximity of the fence line but also due to the potential for concrete damage and possible invasion of roots to the pool itself. 5. Camphor(Cinnamomum camphora)—located in the pool area closest to the Bradford Pears (this is one of two Camphors in the pool area). The Camphor has a circumference of 32 inches at 4.Sft. The upper canopy is sparse and the leaves are small. The tree is being evaluated for removal based on its' declining health and because it appears to have lifted a concrete slab at the pool edge. 6. Monterey Pine(Pinus rac�ia�al—located to the right of the driveway at 10072 Scenic Blvd. This is a large, healthy Monterey Pine. The circumference at 4.Sft. is 87.5 inches. This tree is being evaluated for removal due to the lifting that is occurring at the front of the driveway(the concrete has been lifted about 21/2 inches. Due to the proximity of the trunk to the driveway, it is thought that the roots which aze most likely lifting the slab are too large to cut(there is a concern that cutting the roots will reduce the structural stability of the tree).
