Attn: Vanessa Chow 1 Infinite Loop, MS-2DDC Cupertino, Ca. 95014 SUBJECT: TREE REMOVAL PERMIT ACTION LETTER—Application TR-2012-34 This letter confirms the decision of the Director of Community Development, given on November 28, 2012, approving a tree removal permit to allow the removal of 14 trees to facilitate the construction of a new cafeteria on the adjacent property (20625 Alves Drive), located at 10201 N. De Anza Boulevard. The application is approved with the following conditions: 1. APPROVED PROTECT This approval is based on the arborist report prepared by David Muffly (#WE-4279B), dated October 1, 2012 consisting of 5 pages and a peer review report prepared by David Babby (#WE-4001B), dated October 29, 2012 consisting of 2 pages and a tree removal site plan, except as may be amended by conditions in this resolution. 2. TREE REPLACEMENTS The applicant will not be required to plant any additional trees on-site or off-site as indicated in Tree Removal Permit Application TR-2012-04, Condition No. 5. The proposed amount of trees associated with the new Apple cafeteria project on the adjacent site (20625 Alves Dr) meets or exceeds the amount of replacements required by the Protected Tree Ordinance. Existing tree replacement requirements shall be dictated by Tree Removal Permit Application TR-2012-04. However, the Director of Community Development shall have the discretion to require additional tree replacements as deemed necessary. The final tree replacement plan shall be reviewed and approved prior to final building approval. 3. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90- day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Staff has made the findings necessary to grant the tree removal permit in accordance with Section 14.18.180 of the Protected Trees Ordinance. Please note, however, that an appeal of this decision can be made within 14 calendar days from the date of the mailing of this decision. If this happens, you will be notified of a public hearing, which will be scheduled before the Planning Commission and the trees cannot be removed until a final decision on the appeal has been made. If no appeal is made within the appeal period, the tree(s) may be removed after Wednesday, December 12,2012. OBSERVATIONS The five subject trees (#629 thru 633) align the rear (Bandley Drive), south western half of the south side of 10201 N De Anza Boulevard, adjacent to the Apple Cafeteria project at 20625 Alves Drive. They consist of one coast redwood(#629) and four white alders (#630 thru 633), all of which are very young and small trees with respective trunk diameters of C 7 ,i, � six, seven, ten, six and �ve inches. The grow in a crowded conditions, � and as a result, have weakened vigor and suppressed canopies. Based on the site, it is assumed that the five trees were planted or retained as part of a previously approved and planned development. As such, they can be considered regulated and defined as"protected trees"pursuant to Section 14.18.035(C) of the City Code. CONCLUSIONS AND RECOMMENDATIONS Based on their small size, species and condition, the removal of all five conforms to findings one and/or three of Section 14.18.180 of the City Code. Their removal and replacement with a more suitable species will greatly benefit and promote a healthier and more vigorous future tree landscape. Applying Table A, Section 14.18.185 of the City Code, mitigation for their removal requires the installation of five trees of 24-inch box size. The species should be either Sequoia sempervirens or Cedrus atlantica 'Fastigiata' as specified in the applicant's report. This tree is very close to proposed excavatiori. We are supplementing the retained Redwoods, and propose to replace this tree, with a much more drought adapted tree species (Cedrus atlantica `Fastigata')or native redwood trE�es ,which will result in a much more sustainable long term landscape. Large, valuable lar��er healthier redwoods in the area of this project are being retained, but this tree, due to small size and proximity to excavation will be impacted and should be removed. Alder is also a deciduous species, making it much less useful for permanent screening than evergreen tree species. Also, due to shading, this tree has no lovver branches, which further reduces it's value as a screen tree. The tree would also be imp��cted by construction and excavation of the garage.
