SUBJECT: TREE REMOVAL PERMIT ACTION LETTER -TR-2013-11
This letter confirms the decision of the Director of Community Development, given on May 3, 2013,
approving a Tree Removal Permit (TR-2013-11) to allow the removal and replacement of three (3) Coast
Redwood trees located in a Planned Residential Zoning District(De Anza Oaks), located at 23000 Cricket
Hill, with the following conditions:
1. APPROVED PROTECT
This approval is based on an arborist report prepared by Certified Arborist, Joel Smith (#WE-
8889A), dated March 21, 2013 consisting of four pages and a peer review report prepared by the
City's Consulting Arborist, Michael Bench (#WE-1897A), dated April 3, 2013 consisting of two
pages and a Tree Removal and Replanting Site Plan.
2. TREE REPLACEMENT
The applicant shall plant one 24-inch box Raywood Ash and one 24-inch box Swamp Myrtle trees
as replacements in accordance with 14.18.190 Table A (Replacement Tree Guidelines). These trees
shall be planted according to the tree replacement planting plan, dated Apri115, 2013.
3. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such
fees, and a description of the dedications, reservations, and other exactions. You are hereby further
notified that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If
you fail to file a protest within this 90-day period complying with all of the requirements of Section
66020, you will be legally barred from later challenging such exactions.
Staff has made at least one of the findings necessary to grant the tree removal permit for the dead
tree and prescribed the removal and replacement in accordance with Section 14.18.120B
(Exemptions) and 14.18.190 Table A (Replacement Tree Guidelines) of the Protected Trees
Ordinance.

Review of the Request to Remove and Replace
3 Coast Redwood Trees
De Anza Oaks HOA

Assignment
I was asked by Mr. Stephen Rose, Assistant Planner, City of Cupertino, to review the
request to remove 3 coast redwood trees and to plant replacement trees at the De Anza
Oaks Development, Ridgeway Drive, Cupertino, California.
An Arborist's Report dated March 21, 2013, had been done by Mr. Joel A. Smith, Valley
Crest Tree Care Services.
Observations
I inspected the trees at the site on Apri12, 2013.
The descriptions provided by Mr. Joel Smith concerning the 3 coast redwood trees
(Sequoia sempervirens) are thorough and accurate. I observed the damage to the adjacent
buildings and hardscape. The damage could be expected to increase unless these 3
redwood trees are removed.
The suggested locations for replacement specimens are appropriate in terms of the
available space.
However, the species suggested for replacement require high quantities of water to
perform well. This is especially the case for the 2 species of birches (Betula pendula; B.
papyYifera) and to a lesser degree for the 1 Tupelo (Nyssa sylvatica). There are existing
betula pendula and liquidamber styraciflua, which require high levels of water(compared
to indigenous species) in the suggested replacement area.
Considering the fact that the supply of water is not increasing significantly but may be
decreasing somewhat, partially as a result of environmental conditions, while the demand
for water continues to climb, predictions are that water for landscapes will require
significant reductions in the near future.
Recommendations
I recommend that trees, requiring less water consumption if not drought tolerant species,
be considered for replacements. I suggest the following replacement species:

Value Assessment of the 3 Coast Redwood Trees
The method used for the appraisal of the 3 coast redwood trees (Sequoia sempervirens) is
the Trunk Formula Method, in accordance with the International Society of Arboriculture
( ISA), Guide for Plant Appraisal, 9th Edition. Also, the ISA Western Chapter Species
Classification Guide is used to provide species ratings and to provide a trunk values per
square inch, which is part of the trunk formula method. I have applied the trunk formula
method to a spreadsheet(Microsoft Excel) for the calculation of the 3 trees. The order on
the spreadsheet is the same order(Trees # 1, 2, and 3) described in the report by Mr. Joel
Smith.
The next to last column states the appraised value of the individual tree. The last column
provides a running total.

1) Redwood tree (A) has a circumference of 123". This tree is lifting the sidewalk
leading to the stairway that accesses this unit. The tree is too close to the
walkway for safe root pruning to allow sidewalk repairs. This tree is also very
close to the home and will continue to cause additional damage if retained.
2) Redwood tree (B) has a circumference of 64". This tree is contacted the home
and has crushed the gutter. Gutter repair is currently not possible without causing
extensive damage to the main trunk of the tree. With the tree so close to the
hoine, there is no room for additional growth without additional damage to the
ho me.

3) Redwood tree (C) has a circumference of 140". This tree is in a narrow site
between the curb and the home. The curb as fairly recently been replaced. The
garage floor and foundation wall on the home are both cracked and in need of
repair. The cracks are in close proximity to roots of this tree and they are
believed to be the cause. Root pruning is not recommended due to the close
proximity of cuts on both sides of the tree and the risk this creates for several
ho mes.
