The application is approved with the following conditions: 1. APPROVED PROJECT This approval is based on the arborist report prepared by Gil Mitchell, RCA #317 (WE-0134A), dated August 31, 2012, consisting of 39 pages, a consulting arborist's peer review report prepared by Michael Bench (WE-1897A), dated Received January 30, 2013 consisting of 2 pages and replacement plan entitled "Planting Up-grade and Tree Removal" plan, except as may be amended by conditions in this resolution. 2. TREE REPLACEMENTS Pursuant to the City consulting arborist report, stamped as received January 30, 2013, the entire complex was overplanted at the time of building and replacements on a 1 to 1 basis would be excessive and not recommended. As such, the applicant is required to plant 4 (four) 15-gallon Crape Myrtle, 2 (two) 14-gallon Acer Palmatum, three (3) 14-gallon Flowering Cherry trees, two (2) 15-gallon Pierras, four (4) 5-gallon Euonymous, three (3) 5-gallon Coleonema, three (3) 5-gallon Raphieolepsis, and three (3) 5-gallon Xylosma, and one (1) 5-gallon Pittosporum tobira, consistent with the "Planting Up-Grade and Tree Removal" plan, dated Apri129, 2013. The replacement trees shall be planted within 30 days of the effective approval date of this tree removal permit. 3. INDEMNIFICATION To the extent permitted by law, the Applicant shall indemnify and hold harmless the City, its City Council, its officers, employees and agents (the "indemnified parties") from and against any claim, action, or proceeding brought by a third party against the indemnified parties and the applicant to attack, set aside, or void this ordinance or any permit or approval authorized hereby for the project, including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in defense of the litigation. The City may, in its sole discretion, elect to defend any such action with attorneys of its choice. 4. ACCURACY OF THE PROTECT PLANS The applicant/property owner is responsible to verify all pertinent property data including but not limited to property boundary locations, building setbacks, property size, building square footage, any relevant easements and/or construction records. Any misrepresentation of any property data may invalidate this approval and may require additional review. 5. CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible to consult with other departments and/or agencies with regard to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Departxnent. 6. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90- day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Staff has made the findings necessary to grant the tree removal permit in accordance with Section 14.18.180 of the Protected Trees Ordinance. Please note, however, that an appeal of this decision can be made within 14 calendar days from the date of the mailing of this decision. If this happens, you will be notified of a public hearing, which will be scheduled before the Planning Commission and the trees cannot be removed until a final decision on the appeal has been made. All of the trees are located in the common areas of the property. This is the fourth inventory: 2002, 2005,and 2009 are the years of the previous inventories. Procedures All of the trees on the property are affixed with numbered aluminum disks or tabs and plotted on a map provided originally by Ms. Sharon Heyler. A map is included with this report. The following information was recorded in spreadsheet form: Tree name,tree number,health, structure, prune type,prune cycle,priority, and remarks. Refer to "Explanation of Column Headings" in this report. Site Map The original copy of the map provided by Ms. Heyler has gone through some changes in order that all of the tree numbers are clearly seen on the map. The street names and the house numbers have been added to the map. Tree locations are approximate and are for use as a guide. The survey in 2002 included trees #101-#416,trees that were planted since 2002 include trees#700-#729,trees that were planted since 2005 include#801-#806,and the trees that were planted since 2009 include#1201-#1209. Explanation of Tables Two tables are provided that summarize all the trees by pruning cycle,pruning type, removal,and priority. Priority refers to which trees should be pruned or removed first and is not dependent on the calendar or time of year. There are more trees (272 total) on the property than there are trees (224) identified for pruning or removal. General Impressions The property has a maturing landscape. There are 25 species of trees of which the white birch (Betula pendula) trees amount to 21 percent,the coast redwood (Sequoia sempervirens) trees amount to 15 percent,and the Canary Island pine (Pinus canariensis) trees amount to 16 percent of the total landscape. Of these three species of trees,the Canary Island pines are in the best health but amount to the greatest nuisance on the property. Both the white birch trees and the coast redwood trees are diminishing in health and in fact two large coast redwood trees are in the process of dying. I have seen this happen to coast redwood trees throughout the Santa Clara Valley and there is nothing that can be done about it Photographs Four photographs are provided as a visual aid in the discussion of select trees. One photograph shows the general location of where the Canary Island pine trees need to be pruned to remove the majority of the pine cones on a tree. One photograph shows a white birch tree that is dying and located in a street island Tree Pruning The Best Management Practices TREE PRUNING guidelines should be considered the tree pruning specifications when it comes to crown thinning and crown reduction pruning. Pruning,whether it is done by a tree service or landscape maintenance company, should be done under the supervision of an International Society of Arboriculture Certified Arborist. The eucalyptus trees are rated high priority for pruning. I am recommending pruning the Canary Island pine trees in an effort to mitigate the danger of falling pine cones. Thinning the pine trees would not be effective. They really need to be cut back. Medium priority pruning could be done in another two to three years, and the low priority pruning can be deferred further into the future. Tree Removals Forty-two trees have been identified for removal of which eleven are considered high priority. This amounts to 15 percent of the total treescape which I do not feel is unusual for the age of the property considering the lack of available space that many of these trees are growing in,and the over planting that was done when the property was developed. Tree Fertilization&Irrigation The appropriate method of fertilizing the trees is using the procedure called subsurface hydraulic soil injection. This procedure includes injecting water/fertilizer mix with 200- 400 pounds per square inch of pressure, on 24-36 inch centers (12-18 inch centers for small/young trees) in an area from the stem to beyond the drip line of the tree being fertilized. Fertilization is appropriate for establishing young trees and improving the soil environment for the trees that are growing in acceptable locations. It would not be recommended for trees growing in restricted locations. Irrigation is of equal concern and I believe that a lack of available water is affecting the health of many of the trees that are considered in poor to fair health. Especially the white birch trees that are growing in ivy,newly planted trees that are relying on bubblers,and trees growing in bare/open spaces. I would suggest having an independent water auditor evaluate the irrigation of the trees. The Next Step In Maintaining The Treescape 1. Segregate the trees by priority. Acquire bids from three tree care companies for all of the pruning and removal that is rated high and medium priority. After which it is listed by common name only. Tree# Each tree is given a number. Numbers (on aluminum disks or tabs) appear on the trees themselves and have been put on a map of the property. Health This is a rating based on the overall health of the tree. It is relative to the condition of the leaves (color, size, and amount),the size of wounds and wound closure, and root condition. Fair condition: Try treatments to improve. Poor condition: not treatable. Structure This is a rating based on the distribution of branches, angle of branch attachments, location of wounds, and root structure. Fair structure: Can be improved with pruning. Poor structure: Decay, weak branch attachments, root bound. Prune Type "C T", "C R" are abbreviations for crown thinning, and crown reduction. Refer to the ISA Pruning Guidelines for more details. "P W" is an abbreviation for pruning back the -- �_� branches by three to four whorls in an effort to improve structure and to reduce the _. __- ____:_.m__.. amount of pine cones that can fall and hurt people or property. "Remove" means remove the tree to just above ground line (removing the stump is optional). " D D" is an abbreviation for removing dead wood only. "R S" is an abbreviation for raising the branches and foliage enough so that vehicles can drive under the tree without hitting the branches. This abbreviation is used when raising the canopy is all that needs to be done to the tree. Prune Cycle The recommended frequency of pruning. For example, a "3" indicates pruning every three years. Priority Priority is based in most cases on location, structure, and size of the tree. Remarks Gives further information regarding the particular tree. Observations I inspected the 17 trees on January 30, 2013. The description of each tree was essentially accurate. For example, the coast redwood Trees #170 and#172 are described as "Dying from unknown causes." Indeed, these trees are dying,but my inspection revealed that 2 large roots had been severed for trenching for cable service and for a drain line, which are both located adjacent to the severed roots, which are approximately 12 inches in diameter each. These two roots were observed on the surface of the of the soil,but I suspect that additional roots had been severed during trenching. The soil is slightly depressed in a straight line, which is typically an indication of the location of the trench. Consequently, it is reasonable to assume that these two redwood Trees #170 and#172 are dying as a result of root damage during trenching. I estimate that this trenching occurred approximately 1-2 years past. In my opinion, all of the 26 trees requested for removal are justified. I could make additional comments about several of the trees, but my comments would not be substantially useful or change the assessment. Among the 26 trees, 17 are white birch, (Betula pendula). In addition to these 17 white birch, there are several others that are almost as poor. In the next few years, water resources management predict that water resources will become less available for landscapes, I do not think thirsty species, for example white birch or coast redwood, will be sustainable for the long term. For this reason, I recommend that these be replaced by a species rated to require moderate to low water usage. Replacements according to the Cupertino city guidelines will not likely be effectively feasible. This entire complex was over planted at the time of building. There are virtually no open spaces for additional trees. Replaceinents on a 1 to 1 basis may be excessive in terms of the available space depending on the species used. For this reason, I recommend that some ofthe replacements maybe classified as a small tr,�,�.,�Ll�g��shrub, for� ,� ,,����� 'C,;/ example, Strawberry tree (Arbutus unedo) or Arbutus mari�`d: These'`wC�Ul�ers�t�lt" � _ .� .. For���ady locations, some appropriate specie5 worth consideration are: Cornus kousa (western dogwood) Parrotia persica Stewartia monadelpha Stewartia pseudocamellia Davidia invducrata (Dove Tree) Ilex aquafolium (English holly) Azara microphylla Acer circinatum (Vine Maple) Acer palmatum `Bloodgood' or `Sherwood Flame' (Red Japanese maple) Trees adapted for shade require a very wide planting hole (at least 3 times the nursery container; for example, a 24 inch box tree, should have a planting hole at least 6 feet wide). They should be planted at least 6 inches above the existing soil grade. The soil needs to be rich in organic compost(15% to 25%by volume). Each tree must be well irrigated, especially during the establishment period. Permanent irrigation will be required. It would be essential that each tree have fast drainage. Tree# 380, a Canary Island pine, which is not on the list, has 3 large primary leaders, which are poorly attached in a cluster at approximately 12 feet above grade.
