Chapter 19.164 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. DISCUSSION Proposed Modifications The existing Regnart Heights Station water storage tank is aged and in poor condition. The bolted steel tank is currently over 46 years of age. According to the SJWC the useful life for a bolted steel tank ranges from 35 to 50 years; tanks that are 50 years or older usually cannot provide the desired level of service and will eventually fail. In addition, the existing tank lacks an internal coating and has now corroded and begun leaking at the bottom tier connection to the floor. The applicant, Frank Du with San Jose Water Company, proposes to remove one old water storage tank and install two new water storage tanks, a new PG&E service connection from the driveway to the tank site, and construct a retaining wall and protective fencing. The project would increase overall tank capacity to meet existing service requirements, which are currently deficient. Location The subject project site is located in a residential hillside area near the south-western City limits, bounded by Coyote Ridge Trail to the west and Regnart Road to the east. The proposed area of work lies within a 6,300 square foot public utility easement above the driveway of 22330 Regnart Road, off of a short unpaved access road. The two new tanks will bofh be 24 feet in height and 24 feet and 40 feet in diameter, respectively. The additional height is needed to provide for increased storage requirements and adequate freeboard during a seismic event. Grading and retaining walls are proposed to accommodate construction of the tanks on the existing sloped site. The project will require approximately 220 cubic yards (CY) of cut and 35 CY of fill and the removal of several trees. Other improvements include installation of new PG&E underground service lines to the tank site, replacement of an existing PG&E meter and associated equipment, replacement of an existing storm drain pipe from the tank site, installation of AC paving, catch basins, and seven foot tall fencing around the tanks. Landscaping The plans call f or the removal of two oak trees and eight pine trees ranging in diameter f rom five to twenty-eight inches in accordance with the Tree Removal Mitigation Plan and TR-2013- 28 permit. Replacement planting prescribes a total of sixteen replacement trees in a combination of oak and deodar cedar or canary island pine trees, which will be planted around the new tanks. 2 DIR-2013-18&TR-2013-28 22330 Regnart Road 2 ViSZbZlltlf The predominant views of the proposed water tanks are obscured from view by trees and natural topography from the north, south, and east. The tank will be minimally visible from the west as viewed at a distance from a few homes across the valley and users of the Coyote Canyon Trail. To mitigate the visual impacts, the tanks will be painted California Grouse Tan (Kelly Moore color code. 00-3589BA) which appears as a matte (non-reflective) olive green and will appears as a slightly less faded version of the existing color (see Attachment A). Environmental The environmental impacts of the proposed facility have been reviewed as part of an Initial Study/Mitigated Negative Declaration prepared April 2013 with the California Department of Public Health Division of Drinking Water and Environmental Management serving as the Lead Agency. Noticing This project was noticed to the public in accordance with the requirements of the City of Cupertino zoning ordinance. Additionally, during the Initial Study/Mitigated Negative Declaration Period, notices were posted at the project site and at the Santa Clara County Clerk's Office, and notices were mailed to properties closest to the project site and along the ingress/egress route. During the City public review period, staff received comments from the Midpeninsula Regional Open Space District recommending that a non-reflective olive green color be utilized (with which the selected color complies). ACTION In accordance with Cupertino Municipal Code Section 19.164, the Director of Community Development deems the modification minor and approves the modification described in the plan set titled: "REGNART HEIGHTS STATION TANK REPLACEMENT" prepared by San Jose Water Company, and consisting of ten (10) sheets labeled 1 through 101ast revised 05/30/13 and stamped as received 6/13/2013, except as may be modified by the conditions enumerated below. 1) ANNOTATION OF THE CONDITIONS OF APPROVAL The conditions of approval set forth shall be incorporated into and annotated on the first page of the building plans. 2) BUILDING PERMIT REQUIRED This approval does not constitute building permit approval; a separate building permit is required. 3 DIR-2013-18&TR-2013-28 22330 Regnart Road 2 3) ACCURACY OF THE PROTECT PLANS The applicant/property owner is responsible to verify all pertinent property data including but not limited to property boundary locations, building setbacks, property size, building square footage, any relevant easements and/or construction records. Any misrepresentation of any property data may invalidate this approval and require additional review. 4) COLORS The proposed tanks shall be painted California Grouse Tan (Kelly Moore color code. 00- 3589BA). 5) NO BARBED WIRE FENCING No barbed wire fences shall be permitted; the project plans shall be corrected to remove the reference to barbed wire anti-climb measures. 6) LIGHTING All lights shall be controlled by two-hour maximum timer(s). No lights shall remain permanently illuminated at the facility. 7) ARBORIST REVIEW An ISA-certified arborist shall confirm that the tree protection measures are in place for the existing trees to remain onsite prior to issuance of building permits. The arborist shall confirm the health of said trees following construction prior to issuance of final occupancy. In addition the arborist shall confirm that the new trees were planted properly and according to the approved plans. 8) CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible to consult with other departments and/or agencies with regard to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 9) NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90- day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. 4 DIR-2013-18&TR-2013-28 22330 Regnart Road 2 This approval is effective August 21, 2013. The fourteen calendar day appeal period will expire on September 4, 2013. If no appeal is made within the appeal period, the tree(s) may be removed after Wednesday, September 4, 2013. The tank demolition and reconstruction will require the removal of ten existing trees, two interior live oak Quercus wislizeni and eight pine trees Pinus sp. The city requires replacement tree numbers based on the trunk diameters of the trees being removed (14.18.185). The city requires 24 inch box 1 to 1 replacement ratios for trees less than 12 inches in diameter and 2 to 1 replacements for trees between 12 and 18 inches, and 2 to 1 (24 inch box) or 1 to 1 (36 inch box) replacements for trees larger than 36 inches. Because the size of trees varies, San Jose Water will replace the 10 trees with 15 24 inch box and one 36 inch box tree to satisfy the city's requirement.
