The application is approved with the following conditions: 1. APPROVED PROTECT This approval is based on the arborist report prepared by Samuel Oakley (WE-9474A), dated January 23id, 2014, consisting of 2 pages, a site map, and photos, except as may be amended by conditions in this resolution. 2. TREE REPLACEMENTS The applicant is required to plant two (2) 24-inch box Coast Live Oak replacement trees in accordance with the Protected Tree Ordinance and approved tree replacement plan. Modifications to the tree species and location may be made to the approved replacement plan pending staff approval. The replacement trees shall be planted within 30 days of the effective approval date of this tree removal permit. 3. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS T'he Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Please see Exhibit 1.1 for the relative locations of the subject trees indicated as white dots, and for the location of the replacement tree. The trees were dead upon inspection and removed on January 18, 2014. Cambium tissue along the trunks and branches was pealing back indicating mortality had occurred well before our inspection. A live evergreen tree should be green throughout the year. 7'he exact cause of death is unknown but it is common for native oaks to succumb to i•oot base/flare rot while growing in confined, irrigated, parking lot planting strips. "Heat island effect"from hardscape-reflected radiation in addition to compacted, urban soil, scorching the tree while reducing gas and nutrient exchange, tends to cause additional stress on native oaks. Removal of a dead tree does not require a tree removal permit prior to its removal pursuant to Section 14.18.140 Paragraph B of the City of Cupertino's Municipal Code; however, a subsequent application must be filed within five (5) working days. The trees will require replacement, selected by the Apple arborist to ensure optimal structure, health, and no girdling roots. The selected tree will then be trained from an early age as needed to optimize branching structure, extending the aesthetically and structurally sound lifespan of the tree. Along with the removals, we recommended a full soil renovation of the planters, including rototilling all soil to a depth of eighteen inches (18") and the addition of soil amendments into the root zone. This will encourage deeper rooting,vigorous growth,better performance, and, as a result, less potential for tree mortality. Mulch will be applied and irrigation upgrades installed.
