Box 50157 Palo Alto, Ca. 94303 SUBJECT: TREE REMOVAL PERMIT ACTION LETTER - Application TR-2014-22 This letter confirms the decision of the Director of Community Development, given on June 18, 2014, approving a tree removal permit to allow the removal and replacement of a Redwood Tree located in a Planned Development Zoning District (Mid-Peninsula Housing), located at 10092 Bianchi Way. The application to remove the trees is approved with the following conditions: 1. APPROVED PROTECT This approval is based on the arborist report prepared by Daniel Soto (#WE-8884A), dated July 7, 2013 consisting of 2 pages including site photos and a removal and replacement plan, except as may be amended by conditions in this resolution. 2. TREE REPLACEMENTS The applicant is required to plant one (1) 36-inch box arbutus marina in accordance with the Replacement Tree Guidelines under Section 14.18.190 of the Protected Tree Ordinance and approved tree replacement plan. Modifications to the tree species and location may be made to the approved replacement plan pending staff approval. The replacement trees shall be planted within 30 days of the effective approval date of this tree removal permit. 3. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. The tree is located on the right side yard of apartment#116. My assignment was to evaluate the tree and its parts and assign a level of risk of low, moderate, high, or extreme based on the latest tree risk assessment manual provided by ISA. i was also asked to provide verbal feedback and possible mitigation options for the tree growing extremely close to gas, electrical, and a/c lines Le Beaulieu Apartments is a community for people with speciai needs. The apartments consists of units that comply with the requirements of the Americans with Disabilities Act. This apartment complex was originally developed by Cupertino Community Housing in 1984, this is the assumed date of planting for the Redwood tree as a 24 or 36 inch box container size. The Tree parts of concem in my assessment are branches 3 inches in diameter or larger. Targets are within the drip line and include property, tenants, and maintenance workers that occasionallv occupy the area. As viewed in picture 1 the tree has a circumference of 89" inches measured at four and half feet above natural grade. It is approximately 45 feet tall and has a crown spread of 30 feet. There is no known history of major branch failures but based on information from tenants it is known t h,�t>-�-- � occasionally small dead branches fall in high winds. As viewed, �gor is high, crown is dense, and foliage appears normal. There are no major visible defects in the crown and branches. ( no binoculars were used ) The trunk and root collar appears normal with no signs of cavities or decay. Using the methodologies in the tree risk assessment manual, with a likelihood of failure and impact of Unlike�,y and the consequence of failure being inor the risk rating for the Redwood tree in this report was determined to be Low• Mitigation options are to prune the tree, remove all deadwood and reduce end-weight on longer limbs. Leaving a residual risk of � (very low)if performed. This redwood has low possibilities of causing damage if failure occurs in the canopy. However the same cannot be said about the trees roots, trunk and root collar. These parts are now starting to cause damage to the fence, has caused damage to neighbors property (walkwayj and highly restricts access from the back yard to the front yard and vice versa. However finding practical mitigation options to allow access for disabled people such as handicapped tenant of #116 or future tenants will be hard to achieve. Any renovations to make this area usable or underground utility repairs of any kind can cause detrimental effects on the trees health and will be nearly impossible to achieve without causing mechanical damage to main structural roots an root collar. Having very limited space from building to fence ( 5 1/2 Feet)and at the rate of which the tree is growing it will not be long before the tree starts to cause serious damage due to its size alone. Privacy screening from neighboring properties is the only reason this tree is considered to be retained/protected. It is not a protected species in the City of Cupertino and can be removed without a permit in any other situation. Based on my inspection, tree species, reason for retention (privacy screening) , and high potential decline of the tree if worked to improve site led my client to seek a removal permit as the best mitigation o t�. This will make the area accessible to the tenant and future tenants in any emergency event, wheel chair or not. The replacement of one or two 24 inch box trees from the recommended species list of privacy screening trees for Cupertino will provide instant screening/ coverage as intended. With some regret I must consider this tree to be a good candidate for a tree removal process.
