The application is approved with the following conditions: 1. APPROVED PROTECT This approval is based on the arborist report prepared by Michael P. Young (WC ISA #623), dated July 24, 2014, consisting of one page, and a tree removal plan, except as may be amended by conditions in this resolution. 2. IN-LIEU TREE REPLACEMENT FEES The Director of Community Development has determined that accommodating the two required 24-inch box replacement trees on the property would not be feasible and therefore a tree in-lieu fee would be required. The cost to procure and install the replacement trees is approximately $900, of which the applicant has paid on July 31, 2014, in accordance with the City's Protected Tree Ordinance. 3. NOTICE OF FEES DEDICATIONS RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Staff has made the findings necessary to grant the tree removal permit in accordance with Section 14.18.120 (A) of the Protected Trees Ordinance. There is significant trenching around this tree and it must be removed immediately. Discussion �s:"� � The 21" Coast Live Oak is labelled as Tree #1 in the original Tree °�, Survey from Michael Bench dated March 29th, 2012 (attached and '!� ' see image to right}. At that time Mr. Bench described the tree as: ° ►� Tree#1 has a larqe trunk cavity on the north side. This is a result of a co- � �'_ �' dominant limb foilure many years ago. The shape of the cavity opening and the �.�;;�° - _ �'��j � surrounding tissue provide clues suggesring this type of limb failure. Perhaps more significant is that the canopy is fairly sparse. Ir is unlikeJy that this tree, which is only rn fair condition at best, could survive the grading proposed by the T plans. ,;, � • .�. :�- �_ �_ The old trunk decay (see images to 4 right) is quite significant in this tree and it alone renders this tree unstable. � '� ���� • ��;.M �' � M� ^�'.14 .'}...
