SUBJECT: DEAD TREE REMOVAL PERMIT ACTION LETTER-Application TR-2014-46
This letter confirms the decision of the Director of Community Development, given on August
22, 2014, approving a Dead Tree Removal Permit to allow the removal and replacement of an
approximately 20" diameter dead Monterey Pine tree on a residential parcel located at 22209
Hammond Way. The application is approved with the following conditions:
1. APPROVED PROTECT
This approval is based on staff inspection of the tree by Alex Wykoff and jonathan
Ferrante, dated August 8, 2014, consisting of 1 photo and a replacement plan except as may
be amended by conditions in this resolution.
2. TREE REPLACEMENTS
The applicant is required to plant one (1) 36-inch box or (2) 24-inch box Monterey Pine or
Italian Stone Pine replacement tree(s) in accordance with the Protected Tree Ordinance and
approved tree replacement plan. Modifications to the tree species and location may be
made to the approved replacement plan pending staff approval. The replacement tree(s)
shall be planted within 30 days of the effective approval date of this tree removal permit.
3. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
Staff has made the findings necessary to grant the tree removal permit in accordance with
Section 14.18.120 of the Protected Trees Ordinance.

Good Afternoon Ms. Mancuso,
This email is follow up to our conversation this morning concerning the dead Monterey Pine located on your
property at the above address. After discussion with a colleague and our City Arborist who inspected the tree
and its location on the property, it was determined that the tree must be removed. The attathed aerial
photograph shows its location on your property. Furthermore,the tree has a specimen tag{#457)showing the
retention in conjunction with the development. The good news is although a tree removal permit is required,
there wili be na arborist report required,as our staff arborist was willing to confirm the condition and
recommend replacements. This will save you the cost and time involved in retaining an arborist yourself. The
tree measures 20"4.5 ft.above grade and per the ordinance (Section 14.18.190)two 24" box trees or one 36"
box tree will need to be planted as replacements. The required specimens to select from are as follows:
• Monterey Pine
• Italian Stone Pine � .
As stated,the attached ordinance is for your review. The tree is protected per section 14.18.050 by reason it is,
1) retained as part flf an approved development application and, 2) a code enforcement action.
I will follow up with a letter to you requiring the removal arid provide your with 14 calendar days for that
activity. The retroactive tree removal permit will then need to be filed within 5 business days o#removal. I have
attached a copy of the tree removal permit for you�convenience. You may use the aerial included in this email
as the site plan which is a supporting document required with your application. There are no fees due to the City
when the application is submitted. Your costs wil! be the replacement tree(s) and appropriate irrigation once the
planting has been completed.
