10' Wide Water Line Easement
Grantor hereby further grants to Grantee the right and privilege
to enter upon his lands contiguous to and along the line of said here-
inabove described strip for the pUrpose of locating, constructing, re-
pairing, maintaining, or replacing said water line or appurtenances
thereto, and for the purpose of doing any necessary or lawful act in
connection with the construction or maintenance of said water line
there is also granted the right of the use of sufficient land contig-
uous to said strip on either or both sides therof for the purpose of
excavation of and deposit of earth and necessary building material during
the time of constructing said water line. and any repair thereof.
The foregoing is subject to the following express conditions:
The Grantee agrees to restore the ground surface and any improve-
ments thereon to its original grade or condition insofar as it is prac-
ticable and reasonable to do so.

BEING an easement for water line purposes over a portion of that certain
54.04 acre tract of land described in Exhibit "N' in the Ground Lease to
Forum Lifecare, Inc., recorded December 11, 1987, in Book K387 at page
1708, Series Number 9536539, in the Official Records of Santa Clara County,
State of California; said portion being a strip of land of uniform width of 10.00
feet, by perpendicular measurement, the centerline of which strip being more
particularly described as follows:
BEGINNING at a point lying on the general southwesterly line of aforesaid
54.04 acre tract distant South 330 17' 17" East 288.75 feet from the
northwesterly terminus of that certain course described in aforesaid Exhibit
"A" as having a bearing and distance of South 330 17' 17" East 1392.84 feet;
THENCE leaving said POINT OF BEGINNING and line North 220 28' 55" East
57.73 feet to the terminus of the described centerline.
THE SIDE LINES of aforedescribed easement being shortened or lengthened
so as to intersect with (1) aforesaid general southwesterly line of said 54.04
acre tract and (2) the side lines of a recorded, or soon to be recorded,
10.00-foot wide water line easement lying within the aforedescribed 54.05

WHEREAS, the Ranan Catholic Bishop of San Jose and Rancho San Antonio
Retirement Housing Corporation, Grantor, have executed a Grant of Easement
which is in gxxi and sufficient fonn, oonveying to the City of CUpertino,
Grantee, a ten foot wide water line easement over the property situate in
the City of CUpertino, County of Santa Clara, State of California, mre
particularly described in Exhibit "A" and Exhibit "B", attached hereto and
made a part hereof:
All that certain real property situate in the City of CUpertino,
County of Santa Clara, State of California, oonsisting of approxi-
mately 0.0131 acres, located on cristo Rey Drive at st. JOseph's
Seminary .
101, 'lHEREFORE, BE IT RESOLVED that the City of CUpertino accept said
grant so tendered; and
IT IS FURIHER RESOLVED that the City Clerk is hereby authorized to
