CUPERTINO GATEWAY PARTNERS. a California general partnership
HEREBY grant(s) to the CITY OF CUPERTINO, a non-exclusive easement for
emergency vehicle access, together with the right to construct. repair and maintain any and
all improvements which shall be or become necessary for preservation of the public safety,
welfare or convenience. The said non-exclusive easement for emergency vehicle access
shall be kept open and clear of all obstructions, vehicles and materials. The hereinafter
described property is situated in the City of Cupertino, County of Santa Clara, State of
California, and is more particularly described as follows:
(DESCRIPTION ATTACHED)
City shall be liable for its own negligence and that of its agents~ contractors, employees,
and licensees in the exercise of any rights pursuant to this Grant of Easement.
City agrees that if at anytime the City no longer requires the use of the easement rights
granted herein, then the City shall take all actions reasonably necessary to relinquish and
release such rights, including without limitations, executing a document in recordable form
quitclaiming all rights in and to the easement.
