Camty of Santa Clara, state of california, beirg a conservation
easement for the preservation of specimen trees over a portion of that
certain parcel of lam conveyed to Ishwar P. M.lrarka am Regini S.
Murarka, husbard am wife, as joint tenants, by deed reoarded July 24,
1992 in Book M296 of Official Records at page 557, Santa Clara Camty
Records, beirg a strip of lam of a uniform width of 4.71 feet
described as follows:

Grantor is hereby restricted for specific activity inside the
easements:
1. Restriction of Harmful Practices
Grantor is hereby restricted in his or her use of the prq>erty as
follows:
a. Installation of inprvious pavement beneath the canopy is
prdrlbited.
b. Installation of frequently irrigated plants (once in two
'Neeks or JOOre frequent) is prchibited.
c. Use of sprinkler irrigation beneath the tree canopies, or
irrigation practices which. wet the area within 3 feet of the
trunk is prchibited.
d. Use of tm:n grasses beneath the campy is prcirlbited.
e. Relooval of limbs or branches larger than 12" in diameter
withcAIt a report fran an ISA certified Arborist agreed upon
by both the property owner am the Carm.mi.ty Develcpnent
Director is prchibited.

g. Construction which causes the renDVal of IOOre than 15% of
the a1:sorbin;J root mass of any tree is prdrlbited.
h. Charge of soil grade beneath the canopy, am within 10 feet
of the canopy is prdrlbited.
2. Public utility oarpanies shall not be allOio'ed to trerd1 in the
designated easement area nor shall they be allOio'ed to place wires
above the trees am within the easement.
Grantor hereby further grants to Grantee a right of reasonable acx::ess
am pri vileqe to enter upon his lanJs oontiguau; to am alon;J the line of
said hereinabove described strip for the p.RpOSe of inspection.
It is urrlerstood that the exi.stirg oancrete walkway located on the
sart:herly side of the prcparty, within the hereinabove described
conservation easement, is allowable until such time as it is replaced.
Any such replacement DIJSt meet the requirements set forth above.
Any specific activities described in the hereinabove described
easement do not relieve the Grantor fran oonformi.n:;J to city Ordinance No.
