All that certain real property situate in the City of San Jose, County of Santa Clara, State of
California, being an easement for public utility purposes and sanitary sewer purposes over a
portion of Lot 83 of Tract No. 8325, described as follows:
BEGINNING at the Southeasterly corner of Lot 83 of Tract No. 8325, a map of which was filed
for record in Book 622 of Maps at pages 21 through 25, Santa Clara County Records; thence
from said POINT OF BEGINNING along the Southerly line of said Lot 83 from a tangent bearing
of N87049'SS-W along a curve to the right with a radius of 1050.00 feet through a central angle
of 0039'18- for an arc length of 12.00 feet; thence leaving said Southerly line N44052'3Q-E 17.34

ACCEPTING A GRANT OF EASEMENT FOR PUBLIC UTILITY PURPOSES
FROM SCS DEVELOPMENT COMPANY, A CALIFORNIA CORPORATION
CCIT A TION HOMES), LOCATED OVER A PORTION OF LOT 83 OF TRACT
NO. 8325, SOUTHEAST CORNER OF DE ANZA BOULEVARD AND
HOMESTEAD ROAD
WHEREAS, SCS Development Company, a California Corporation, Grantor, has
executed a Grant of Easement which is in good and sufficient form, conveying to the City
of Cupertino, Grantee, an easement for public utility purposes over the property situate in
the City of Cupertino, County of Santa Clara, State of California, more particularly
described in Exhibit "A" and Exhibit "B", attached hereto and made a part hereof:
All that certain real property situate in the City of Cupertino, County of
Santa Clara, State of California, located at the southeast corner of De Anza
Boulevard and Homestead Road.
NOW, THEREFORE, BE IT RESOLVED, that the City of Cupertino accept said
. grant so tendered; and
IT IS FURTHER RESOLVED that the City Clerk is hereby authorized to record
said Grant of Easement and this resolution.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Cupertino this 7th day of Auqust , 1995, by the following vote.
