All that certain real property situated in the City of Cupertino, County
of Santa Clara, State of .California, more particularly described as fol-
lows:
A strip of land 10 feet wide the Easterly line of said strip of land des-
cribed as follows:
Beginning at the Southeast corner of the 10.268 Acres, parcel of land as
shown on that certain Record of Survey recorded in Book 117 of Maps at
Page 31, Santa Clara County Records:
Thence the following courses and distances along the Easterly line of
said parcel of land the following courses and distances:
(a) N.6 044'50"W. , 183.71 feet;
(b) N.8 019'50"W. , 182.82 feet;
(c) N.3 013'10"W. , 66.00 feet;

Upon the following terms and conditions: E 1 G'!GE 17
Grantor hereby further grants to Grantee the right and privilege -to enter upon his
lands contiguous to and along the line of said hereinabove described strip for the
purpose of locating, constructing, repairing, maintaining, or replacing said storm
drain or appurtenances thereto, and for the purpose of doing any necessary or lawful
act in connection with the construction or maintenance of said storm drain; there is
also granted the right of the use of sufficient land contiguous to said strip on
either or both sides thereof for the purpose of excavation of and deposit of earth
and necessary building material during the time of constructing said storm drain and
any repair thereof. The Grantee agrees to restore the around surface and any improve-
ments thereon to its original grade or condition insofar as it is practicable and
reasonable to do so.
All costs of legal advertisement will be borne by the City of Cupertino.
The provisions hereof shall inure to the benefit of and bind the heirs,
successors and assigns of the respective parties hereto.
IN WITNESS WHEREOF the said District by and through the duly authorized
Clerk of this Board of Trustees has executed this Grant of Easement this

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
ACCEPTING A GRANT OF EASEMENT FOR STORM DRAIN PURPOSES
FROM THE CUPERTINO UNION SCHOOL DISTRICT LOCATED ALONG
THE EASTERLY BOUNDARY OF STEVENS CREEK SCHOOL
WHEREAS, there has been executed a Grant of Easement for Storm Drain purposes
which is in good and sufficient form granting to the City of Cupertino, County
of .Santa Clara, State of California, easement over certain real property for
storm drain purposes, situate in the City-- of -Cupertino, more particularly described
in Exhibit ''A" and Exhibit "B", attached hereto and made a part hereof.
NOW, THEREFORE, BE IT RESOLVED, that the City of Cupertino accept said
grant so tendered; and
IT IS FURTHER RESOLVED, that the City Clerk be and he is hereby authorized
to record said dedication and this Resolution.
PASSED AND ADOPTED at a regular meeting of the City Council of the City

RE: EASEMENT ADJACENT TO STEVENS CREEK SCHOOL
In a letter dated October 17, 1978, we furnished you with the original
and one copy of the Grant of Easement for storm drain purposes adjacent
to Stevens Creek School . It was requested that you advise my office
of the date, book and page number and official recording number and
also return to us one fully recorded copy for our files.
To date we have not received a response to this request. It would be
appreciated if this could be furnished as soon as possible so that we
might close our file on this transaction.
