Grantor hereby further grants to Grantee the right and'pr� I' - e tZ

enter upon his lands contiguous to and along the line of said T?bre'* above
described strip for the purpose of locating, constructing, repairing or
. maintaining said pedestrian and equestrian easement for the
purpose of doing any necessary or lawful act in connection with the con-
struction or maintenance of said pedestrian and equestrian easement
there is also granted the right of the use of sufficient land contiguous to
said strip on either or both sides thereof for the purposes of excavation
of and deposit of earth and necessary building material during the time
of constructing said pedestrian and equestrian easement and any repair
thereof.
The foregoing is subject to the following express conditions;
The Grantee agrees to restore the ground surface and any improvements
thereon to its original grade or condition insofar as it is practicable and
reasonable to do so.

A 20 foot Pedestrian and Equestrian Easement more particularly
described as follows :
Being a portion of Lot 8 as shown upon that certain Map entitled
"Tract No. 5990 Rainbow's End" , which map was filed for record
in the office of .the recorder of the County of Santa Clara, State
of California on May 22, 1979 in Book 442 of Maps at pages 12 and
13;
Beginning at the southeasterly common corner of Lots 8 and 21
as said corner is shown upon the map of said Tract No. 5990 above,
thence N 500 44 ' 15"W, 27. 14 feet along the common line of said
Lots 21 and 8; thence leaving last said line S 030 16 ' 00"E, 42. 82
feet to the point of intersection thereof with the northerly line
of the pedestrian and equestrian easement, as said easement is
shown upon the map of said Tract No. 5990 above referred to; thence
southeasterly along last said line along an arc of a curve to the
right, from a tangent bearing S 560 23 ' 48"E, with a radius of 50. 00
feet, through a central angle of 530 07 ' 48" for an arc distance of
46. 36 feet to the intersection thereof with the easterly line of
said Lot 8 as said Lot 8 is above referred to; thence along last

PURPOSES FROM L;& L PROPERTIES, .INC. LOCATED WITHIN TRACT
5990 RAINBOW'S END, ALONG THE NORTHEAST CORNER OF LOT 8,
APPROXIMATELY.0.02 ACRE
WHEREAS, there has .been executed a Grant of Easement for Pedestrian
and Equestrian Purposes which is in good and suf-
ficient form granting' to the City of Cupertino', County of Santa Clara, State
of Calfornia, easement over •certain real property for Pedestrian
and Equestrian purposes, situate in the City of Cuper-
tino, more particularly described in Exhibit "A" and Exhibit "B" , attached
hereto and made a part.-hereof.
NOW, THEREFORE,', BE IT RESOLVED, that the City of Cupertino accept said
grant so tendered; and
IT IS FURTHER RESOLVED, that the City Clerk be, and he is hereby authorized
