The application is approved with the following conditions: 1. APPROVED PROJECT This approval is based on a report prepared by a certified arborist, Simon Tunnicliffe (WE 7505A), dated July 20, 2014, consisting of 2 pages and a peer review report prepared by a certified arborist, Michael Bench (WE 1897A), dated October 2, 2014 consisting of three pages tree and a removal and a tree replacement site plan, except as may be amended by conditions in this resolution. 2. TREE REPLACEMENTS The applicant is required to plant two (2) 24-inch box trees or one (1) 36-inch box tree in accordance with the Protected Tree Ordinance and approved tree replacement plan. Modifications to the tree species and location may be made to the approved replacement plan pending staff approval. 3. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservaHons, and other exactions. You are hereby notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exaction, pursuant to Government Code Section 66020(a), has begun. NorikoYanagisawa Residence 21045 Freedom Drive Cupertino, California Buildings settle and foundations crack Assignment I was asked by Kaitie Groeneweg, Planner, City of Cupertino, to review the request to remove a pine tree in the back yard of 21045 Freedom Drive, Cupertino, California. Observations I inspected the site on October 2, 2014. The subject tree is a Canary Island Pine (Pinus canariensis). This tree is 28 inches in diameter at 54 inches above grade. The tree is located approximately 12-15 feet from the residence. This tree has a tree tag# 145. I inspected this tree from the Alves Drive side. It is located outside the wood fence on the Alves Drive side of the street. I was able to look over the fence into the back yard of 21045 Freedom Drive. The roots of this tree are indeed raising the tile and the concrete patio in the back yazd at this location. I could not see any damage to the foundation, and it is unlikely that this tree has damaged the foundation. The tree leans slightly toward the residence in response to adjacent redwood trees. I measured the lean using a carpenter's level, an application on my phone. The lean is less than 10 degrees, which is typical of most trees. Very few trees stand perfectly straight. I consider the accumulation of pine needles on the roof to be the responsibility of the home owner to clean and not a reason to remove a tree. 1 Prepared by Michael L. The possibility of injury is remote from a falling cone but within the realm of feasibility. Conclusions Among the reasons for requesting this tree's removal,the only reason I consider valid is the fact that the back yard patio has suffered damage.Although this damage is relatively minor at this point, it will most certainly increase. Root cutting for repairs to the patio may render the tree unstable, which is not an option. The competition with the other trees is a significant part of the problem concerning this tree and concerning many of the other trees in this development. Recommendation I recommend the application for removal of this Canary Island Pine tree be approved on the basis of damage to the patio,which would only increase over time. It will be essential to grind the stump in order to prevent a hot bed of inoculum of oak root fungus (Armellaria mellea), which could infect a replacement tree. I suggest the replacements be from the following list. These are low water consumers after they become established, and they are not known to damage infrastructure.
