Concord, CA 94520 SUBJECT: TREE REMOVAL PEItMIT ACTION LETTER—Application TR-2014-58 This letter confirms the decision of the Director of Community Development, given on December 11, 2014, approving a Tree Removal Permit to allow the removal and replacement of 68 protected trees in an existing office complex (Cupertino City Center), located at 20350 Stevens Creek Blvd. The application is approved with the following conditions: 1. APPROVED PROJECT This approval is based on a report prepared by a certified arborist, Sarah Hon (WE 9519A), dated October 15, 2014, consisting of 17 pages and a Recommendation for Planting Replacement Trees report prepared by a certified Arborist, Michel Bench (WE1897A) consisting of 2 pages and a tree removal and replacement plan, except as may be amended by conditions in this resolution. 2. TREE REPLACEMENTS The applicant is required to plant sixty one (61) 24-inch box trees and seven (7) 36-inch box trees in accordance with the Protected Tree Ordinance and approved tree replacement plan. Modifications to the tree species and location may be made to the approved replacement plan pending staff approval. 3. REPLANTMENT PLANTING REQUIREMENTS The following requirements are based on the recommendations provided by the City's consulfing arborist in the report dated November 14, 2014 to ensure the health of the replacement trees. a. The soil located in the replacement trees planting areas shall be fractured to the depth of the soil compaction or to the greatest extent possible prior to the planting of each tree. b. Where possible replacement trees shall be planted in planting pits that are 3 to 5 times the size of the tree container. c. The planning pits for the replacement trees shall have rough edges where possible. d. When possible, add organic material (2%-5% by soil volume) during the fracturing of the soil. e. If the soil contains high clay amounts which require soil amendments a soil scientists shall be used to make recommendations on the soil amendments. f. In the event that the soil fracturing is deeper than the size of the tree container, the soil directly under the planted tree shall be re-compacted. g. New trees should be planted 6 to 8 inches above the surrounding grade. 4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exaction, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Staff received comments from two neighboring property owners during the public comment period. The concerns generally related to the number of trees being removed, the replacement tree species and noise impacts during the removal process. The subject trees are being removed because they are irreversible diseased and/or dying. T'he applicant provided an arborist report detailing the condition of each tree. This report was also peer reviewed by the City's consulting arborist who confirmed the accuracy of the report. Conditions of approval have been added based on the recommendation of the City's consulting arborist to ensure the health of the replacement trees on the site. The trees to be removed will each be replaced with a new tree in accordance with the Protected Tree Ordinance. During the removal process the applicant will be required to follow the regulations described in the Community Noise Ordinance which limits the construction hours and allowed level of noise. Staff supports the removal of the trees since the proposed removal and replacement plans are consistent with the City's Ordinances. Staff has made the findings necessary to grant the tree removal permit in accordance with Section 14.18.180 of the Protected Trees Ordinance. Also, please note that an appeal of this decision can be made within 14 calendar days from the date of this letter. If this happens, you will be notified of a public hearing, which will be scheduled before the Planning Commission. Previous insecticide treatment was ineffective and several tulip trees have already been removed and replaced with other trees. Observations and The inventory was completed on June 26,2014. There are 61 tulip trees on-site,the Discussion majority of which do not exceed 12"in diameter(diameter at breast height,or DBH). Many of the trees have sparse canopies with blackened branches, indicative of sooty mold growing on surfaces covered with honeydew. Observations of the sucking insect responsible for the honeydew were not made but were previously identified as tuliptree scale and aphids. Recommendations We recommend that all 61 tulip trees be removed and replaced by new trees that are suitable for the site and resistant to aphids and scale infestation. As requested by the client,due to budgeting restrictions,the removal and replacements will occur in 2 phases within 6 months of each other. Phase I is the removal and replacement of the 39 tulip trees along the walkway(see Fig.3). Phase II is the removal of the remaining 22 tulip trees in lower traffic areas will be removed and replaced(see Fig 4). I recognize that the"Long Term"recommendation may not be practical at a location such as the Cupertino Town Center. The alternative solution, which I consider to be a relatively"short term" solution, is certainly a viable solution and no doubt a more practical one. Recommendations 1. I recommend that the soil be fractured to the extent possible for the planting of each tree. This requires breaking up the compacted soil to the depth of compaction. The depth of compaction may not be the same at all locations. Determining the depth of compaction will require excavation(for example, test pot holes) and inspection. 2. The area to be fractured depends on the space available for each tree, or group of trees, but in all cases, the size of the planting hole must be larger than the tree container. It would be preferred that that the width of the planting hole must be 3- 5 times the size of the tree container. For example, it would be preferable for the planting hole for a 24 inch boxed tree to be 6-10 feet wide in diameter. Of course, this will not be feasible at many locations, but for every tree that would be planted in larger fractured planting pit, that tree would have a longer viable life span, provided it would not be"root bound"upon arrival from the nursery. 3. Whatever the size of the planting pit that would be achieved for each tree, it would be essential that the edges of the planting pits be made very rough and jagged. There is a tendency to dig the planting pits leaving the sides of the holes smooth, possibly having almost a polished look. I have encountered workers very proud of the neatly dug holes with very smooth sides. Unfortunately this is not good for root growth. By making the sides of the holes very rough and jagged, this promotes root grown into the compacted outer soil. If this is not done, the new trees often become root bound in their individual planting holes. Prepared by Michael L. I suggest adding a little organic material (approximately 2%-5%by soil volume) during the fracturing of the soil. It is usually not necessary to mix the organic material. Simply spread approximately 2 inches of nitrified compost over the soil before fracturing the soil. The organic material will help keep the soil from re- compacting. 5. If the soil has a high clay content, it may be useful to add a small amount of gypsum, which is useful to keep the soil loosened. The exact amount, plus any other soil amendments, would require the advise of a soil scientist, such as Jim Kelly or the Soil and Plant Lab (Winchester Boulevard, Santa Clara). 6. In the event that the soil fracturing would be deeper than the tree container, it would be essential to re-compact the soil directly under the planted tree. Otherwise, the planted tree would sink, which would later expose it to fungus diseases. New planted trees must be planted 6-8 inches above the surrounding grade, which would form a slight mound. That is the first or top roots must be 6-8 inches above surrounding grade after planting. In addition, the soil directly below the trunk(approximately 12-18 inches in diameter) must be compacted enough that the tree would not settle or sink.
