The application is approved with the following conditions: 1. APPROVED PROJECT T'his approval is based on the arborist report prepared by Sam Oakley (WE-9474A), dated December 8�, 2014, consisting of 6 pages except as may be amended by conditions in this resolution. 2. TREE REPLACEMENTS The applicant is required to plant two (2) 36-inch box Acer Buergerianum and one (1) 36-inch box Pyrus Calleryana replacement trees in accordance with the Protected Tree Ordinance and approved tree replacement plan. Modifications to the tree species and location may be made to the approved replacement plan pending staff approval. The replacement trees shall be planted within 30 days of the effective approval date of this tree removal permit. 3. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Please see Exhibit 1.1 for the relative locations of the subject trees indicated with white/red dots, and for the location of the replacement trees. The pear tree fell over on December 3, 2014, and was removed as a result of its failure on December 4,2014. The sweetgums were dead and removed on the same day as the pear. The root system was likely compromised due to the water-stress caused by the 2014 drought. Water-stress introduced a vector for root rot. The extreme storm event was the first storm after a very long and hot summer. Once the soil was saturated with water, the compromised root system had no support from the surrounding soil and failed. This scenario is very common and happened at multiple locations in the Gity of Cupertino during the stonn event. This condition is not preventable nor is it predictable. The sweetgums were detennined to be dead due to their extensive loss of foliage,severely desiccated cambium tissue, and widespread fungal infection exhibited by fungal conks growing all along the trunks (see Exhibits 1.3 & 1.4). A test for live cainbium tissue had negative results. The other sweetgums on the property, although seasonally shedding their foliage, were relatively healthy with vigorous growth and lack fungal conks. Removal of dead trees and protected trees in case of emergency caused by the hazardous or dangerous condition of the tree does not require a tree removal pennit prior to its removal pursuant to §14.18.140 (a)&(b)of the City of Cupertino's MLUlicipal Code; however, a subsequeut application must be filed within five (5) working days after the removal of the trees.
