Grantor hereby further grants to Grantee the right and privilege
to enter upon his lands contiguous to and along the line of said here-
inabove described strip for the purpose of locating, constructing, re-
pairing, maintaining, or replacing said water line or appurtenances
thereto, and for the purpose of doing any necessary or lawful act in
connection with the construction or maintenance of said water line
there is also granted the right of the use of sufficient land contig-
uous to said strip on either or both sides therof for the purpose of
excavation of and deposit of earth and necessary building material during
the time of constructing said water line, and any repair thereof.
The foregoing is subject to the following express conditions :
The Grantee agrees to restore the ground surface and any improve-
ments thereon to its original grade or condition insofar as it is prac-
ticable and reasonable to do so.

California, the centerline of. said easement being more particularly
described as follows:
Beginning .at a point on the westerly line of that certain 10.268 acre
parcel as shown on that certain "Record of Survey of a Portion of the
Rancho San Antonio," filed for record on March 3, 1960, in Book 117 of
Maps at page 31, Santa Clara County Records, said point being distant
along said westerly line South 1049'05" east 534.24 feet from the north-
westerly corner of said 10.268 acre parcel, said corner being along the
southerly line of Hartman Drive (40 feet wide) as shown on said afore- ,
mentioned map;
Thence from said Point of Beginning leaving said westerly line along the

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
ACCEPTING GRANT OF EASEMENT FOR WATER LINE PURPOSES FROM
CUPERTINO UNION SCHOOL DISTRICT LOCATED AT THE STEVENS CREEK SCHOOL
SITE EAST OF AINSWORTH DRIVE
WHEREAS, Cupertino Union School District, Grantor, has executed a
Grant of Easement for water line purposes which is in good and
sufficient form granting to the City of Cupertino, County of Santa
Clara, State of California, easement over certain real property for
water line purposes, situate in the City of Cupertino, more
particularly described in Exhibit "Al' and Exhibit "B", attached
hereto and made a part hereof, which is as follows:
All that certain real property situate in the City of Cupertino,
County of Santa Clara, State of California, consisting of
approximately 0.20 acre located at the Stevens Creek School site
east of Ainsworth. Avenue.
NOW, THEREFORE, BE IT -RESOLVED, that the City of Cupertino accept
said grant so tendered; and
IT IS FURTHER RESOLVED that the City Clerk be and she is hereby
authorized to record said dedication and this Resolution.
PASSED AND ADOPTED at a regular meeting of the City Council of
the City of Cupertino this 19th day of November, 1984 by the
