APPROVED PROTECT This approval is based on a document consisting of one (1) page and a plan set entitled, "Sign Program, Stanley Square, 21666-21686 Stevens Creek Blvd, Cupertino" consisting of 2 sheets dated November 2, 2011, except as may be amended by conditions in this resolution. 2. BUILDING PERMIT REQUIRED This Sign Program approval does not constitute building permit approval. A building permit is required for each separate sign indicated on the sign program unless the Building Department determines that it is not necessary to obtain one. 3. CHANGES TO SIGN PROGRAM A new Sign Program application, for review and approval of the Planning Department, is required prior to making any changes to the approved Sign Program. 4. ACCURACY OF THE PROTECT PLANS The applicant/property owner is responsible to verify all pertinent property data including but not limited to property boundary locations, building setbacks, property size, building square footage, any relevant easements and/ or construction records. Any misrepresentation of any property data may invalidate this approval and require additional review. 5. CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible to consult with other departments and/or agencies with regard to the proposed project for additional conditions and requirements. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Goverrunent Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Staff has made all the findings that are required for approval of a Sign Program as required by the of Cupertino's Municipal Code, Section 17.24.020(C). GENERAL REQUIREMENTS The attached plans show signage in place at the time of this sign program revision. The following guidelines are intended to accommodate future revisions required because of changes in use or tenant. All signs at this project must be approved by the landlord and conform with the City of Cupertino sign ordinance and Monta Vista Design Guidelines. All signage must be externally illuminated. Total signage per tenant is limited to 200 square feet (or maximum allowed under City sign regulations). The allowed area and length is 1 square foot per linear foot of store frontage on which the sign is located. TENANT MARQUEE SIGNS Tenant marquee signs on the front of the building should be individual raised metal letters flush mounted on the building fascia. Letters should be no more than 8 inches in height. Font must be approved by the landlord. Lettering is to be white, black, dark green or plum to reasonably compliment building colors as approved by landlord. (See Sheet A.02; Exterior Elevations). IMPERIAL AVENUE SIDE SIGNAGE Upon approval of the landlord, the end tenant with frontage on both Stevens Creek and Imperial Avenue will be permitted to have one additional sign to be mounted on the building on the Imperial Avenue side. The sign shall be mounted so that it does not project above the building siding into the area of trim defining the bottom of the parapet wall. Sign must meet the ma�cimum square footage limitations as specified above. Colors, configuration, font and materials of the sign must be approved by the landlord to compliment building. (See Sheet A.02, Exterior Elevations) and conform with Monta Vista Design Guidelines. BLADE SIGNAGE Blade Signage shall be oval, rectangular or a shape approved by Landlord and shall not exceed 2 '/z feet wide by 2 feet high, maximum 6.5 square feet area only as permitted by city sign regulations. All signage shall be installed between 8 feet and 12 feet above walk surface at under side of frontage walkway canopy near tenant front door entrance. Conformance will be strictly enforced, and any installed non-conforming or unapproved signs must be removed or brought into conformance at the ea�pense of Tenant. This criteria may be updated periodically by written notice from Landlord to Tenant. Landlord recommends to Tenant that Tenant share a copy of this sign criteria with Tei►ant's sign contractor. A. General Requirements 1. Tenant shall submit or cause to be submitted to Landlord for approval before construction a copy of its preliminary sign design, including materials, colors, dimensions, size, layout, and positioning. Such submissions shall include a scale drawing of the proposed sign. 2. All signage shall be in conformance with the sign criteria previously established with or by the City of Cupertino. No "can" or "pan channeP' signs are permitted. No Plexiglas-backed signs are permitted. The sign criteria for the Center is restricted to individually lettered raised-metal or raised-plastic signs to be mounted on the building fascia above the Premises. Lettering is to be white,black or dark green to reasonably compliment the building colors. The existing tenant signs are also permitted. 3. All signage must be externally illuminated by the landlord provided illumination only. No internal illumination is pernutted. 4. All permits for signs and their installation shall be obtained by the Tenant or its representative, at Tenant's eapense. 5. All signs shall be constructed and installed at Tenant's expense. 6. Tenant shall be obligated one time to bring its signs into conformance at Tenant's sole expense with any change in the criteria established with the City of Cupertino in agreement between Landlord and the City of Cupertino. 7. Tenant shall be responsible for the fulfillment of all requirements of these criteria and this Lease and shall submit samples of sign material if requested by Landlord. 8. All signs shall be permanent in nature, except for"grand opening" signs, w�hich may be banners. Such "grand opening" signs may not be displayed beyond thiriy (30) days (or shorter period as directed by the City� of Cupertino)from the beginning of Tenant's lease. 9. All signs shall be maintained by Tenant in first-class condition throughout the term of Tenant's lease. B. General Specifications 1. No electrical changes to the landlord provided illumination is permitted, including no changes to raceways,crossovers or conduits. 2. Visible fasteners are not permitted. C. Location of Signs 1. External signs shall be permitted on the building fascia, unless specifically approved otherwise in writing by Landlord and the City of Cupertino. 2. No "A-frame" signs are pemutted anywhere on the property or the adjacent sidewalks. Landlord may impound such signs found anywhere on the property or the adjacent sidewalks. Landlord shall release to Tenant any impounded signs only after Tenant has remitted to Landlord the reasonable storage costs of Landlord. Reasonable storage costs are hereby defined as no less than�25 per month and no more than$100 per month with a minimum storage cost of$25. Unclaimed signs may be disposed of by Landlord after three (3)months,but only after Landlord has provided Tenant with a minimum of thirty(30)days written notice. D. Design Requirements 1. Wording of Tenant's signs shall not include the name or type of product sold unless such is part of Tenant's trade name or insignia. 2. Sign lettering shall be individual letters or script. Letters shall be no less than 6 inches in height, nor no more than 10 inches in height,all to fit within the building fascia. The total sign area(as measured by city standards)shall be no more than 0.75 square foot for every foot of the frontage of the Premises, unless further restricted by City of Cupertino standards. Exceptions to this limitation must be approved by the City of Cupertino and in writing by the Landlord. The Landlord may use its sole discretion in determining exceptions to this sign area limit. 4. The fascia (storefront) sign shall be externally illuminated by lighting provided solely by the Landlord Such illumination, both the cost of electricity and the cost of maintaining the lighting fixtures, shall be maintained by the Landlord at the sole cost of Tenant. E. Construction Requirements 1. All penetrations of the building structure required for sign installation shall be neatly sealed in a watertight manner. 2. No labels will be permitted on the exposed surface of signs except those required by local ordinances which shall be applied in an inconspicuous location. 3. Tenant shall repair any damage caused by Tenant's sign contractor. Tenant shall be fully responsible for the operations of Tenant's sign contractor. F. Miscellaneous Requirements 1. Tenant may install on its storefront, if required by the U.S. Postal Service, only the numbers of Tenant's street address and only in such location as Landlord shall specify. Landlord shall also specify size, type and color of numbers. 2. Except as provided herein, no advertising placards, banners, pennants, names, insignia, trademarks, or other descriptive material shall be ai�xed to or maintained on the exterior of the glass panes, suppoRs of the show windows and doors, or upon the exterior walls of the storefront or the building in which the Premises are located, except as may be permitted by Landlord in its sole discretion.
