Staff has made the finding that the development trees in the P(CG, Res) zoning district are in declining health or fall within the proposed development footprint. This finding is necessary to grant the tree removal permit in accordance with Section 14.18.180 (A)(1) of the Protected Trees Ordinance. The application is approved with the following conditions: 1. APPROVED PROjECT T'his approval is based on the arborist report prepared by Jon Maystrik (#WE-7363A), received Apri19, 2015, consisting of eight pages; and a tree removal site plan, except as may be amended by conditions in this resolution. 2. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exaction, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Bruce Chan, Landscape Architect, requested that Arborwell review the trees for the proposed project. The trees are located at 19608 Pruneridge Ave, Cupertino, Ca 95014. This report summarizes the results of my examination. My assignment was to provide a written report detailing my observations of the health, structure and current condition of trees. Only a visual assessment was requested, and a root crown excavation was not performed. A complete examination of main structural roots was therefore not performed and was not part of the assignment. Observations I examined the following trees on Wednesday February 25, 2015: Three(3) Grevelia robusta (silk oak) and Two(2) Liquidambar styraciflua(sweet gum). They are located in at the rear of the Clubhouse within a rear access walkway. The silk oak trees are semi mature and measure 19, 17 and 15 inches in diameter at breast height (DBH). They are approximately 50 feet in height with a crown spread of 15 feet. The structure of the crown is upright and spreading, typical for this species. The juvenile sweet gum trees measure 7 and 5 inches DBH. They are approximately 20 feet in height with a crown spread of about 8 feet. The foliage of all trees is normal size for the species and age. The silk oak trees all possess codominant leaders with some bark inclusion. The largest of the three trees has some root decay visibly evident. There are several old pruning wounds on the silk oak trees from past pruning, mostly to provide overhead clearance and clearance from adjacent structures. Some previous history of branch failure has been noted in all three silk oak trees. The liquidambar trees appear to have been an installation within the past 5-8 years. Arborwell 3/4/2015 pro(essional trae m�nag�ment The silk oak trees are planted fairly close to the adjacent structures. Some branches are touch the fa�ade of the building. These trees share a drip line within the edge of a playground. Based on the results of my examination, I have concluded that the trees possess a low potential for trunk or branch failure. The trees are in reasonably good health and fair structure. Discussion Silk oak trees are known for weak branch attachments and prone to limb failure. They have been planted particularly close to the adjacent buildings and will require regular pruning to keep trees safe and prevent them from growing over the watl into nearby property. Sweet gum trees are also prone to broken limbs and invasive root systems. The proximity the trees have to the adjacent hardscape increases the risk of root damage to concrete, sidewalks, etc. Root and regular tree pruning will be required to maintain the current condition of the site. Recommendations Given the evidence described in this report, it is my professional opinion that the trees be removed and replaced to allow for construction of the new patio and replaced with more suitable species of tree in order to symbiotically live with the community.
