Staff received comment about pattern of tree removal in the neighborhood. The referenced tree removals, one redwood and two pine, are not protected per the Protected Trees Ordinance. The Deodar Cedar is a protected tree. As part of the tree removal permit, the applicant is required to plant replacements consistent with Table 14.18.160 (A). The approved Tentative Map (TM-2013-01) for the project area indicated the removal of the cedar tree. The applicant will be planting a thirty-six (36) inch box California Buckeye that is consistent with tree replacement requirements and is a protected tree. Staff has made the finding that the Deodar Cedar restrict the economic enjoyment of the property by limiting the use of the property in a manner not typically experienced by owners of similarly zoned and situated property, and the applicant has demonstrated no reasonable alternatives to preserve the tree. The current location of the trees is in the way of proposed development and grading. The finding is necessary to grant the tree removal permit in accordance with Section 14.18.180 (A) (3). The application is approved with the following conditions: 1. APPROVED PROTECT This approval is based on the arborist report prepared by Robert Booty (#WE-487), dated April 17, 2015, consisting of two pages; and a site plan, except as may be amended by conditions in this resolution. 2. TREE REPLACEMENTS The applicant is required to plant one (1) 36" box Aeculis Californica (California Buckeye) tree for the tree removal in accordance with the Protected Tree Ordinance. Modifications to the iree species and location may be made to the approved replacement plan pending staff approval. 3. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The condiHons of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exaction, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Please note that an appeal of this decision may be made within 14 calendar days from the date of this letter. Do NOT REMOVE THE TREE until the end of the appeal period. If an appeal is filed, you will be notified of a public hearing, which will be scheduled before the Planning Commission.
