Staff has made the finding that the three (3) Canary Island Pines restrict the economic enjoyment of the property by limiting the use of the property in a manner not typically experienced by owners of similarly zoned and situated property. The current location of the trees is in the way of proposed development and grading. The finding is necessary to grant the tree removal permit in accordance with Section 14.18.180 (A) (3). The application is approved with the following conditions: 1. APPROVED PROJECT This approval is based on the arborist report prepared by Sam Oakley (#WE-9474A), dated May 20, 2015, consisting of four pages; including a removal and replacement site plan and a photograph and a Site Plan, entitled "Apple Bubb 8/10 Patio" consisting of one page labeled "C-100" dated Apri12015, except as may be amended by conditions in this resolution. 2. TREE REPLACEMENTS The applicant is required to plant two (2) thirty-six (36) inch box Swan Hill Olive trees and one (1) thirty-six (36) inch box Coral Bark Japanese Maple in accordance with the Protected Tree Ordinance. Modifications to the tree species and location may be made to the approved replacement plan pending staff approval. 3. NOTICE OF FEES,DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The conditions of Project Approval set farth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exaction, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Please note that an appeal of this decision may be made within 14 calendar days from the date of this letter. Do NOT REMOVE THE TREES until the end of the appeal period. If an appeal is filed, you will be notified of a public hearing, which will be scheduled before the Planning Commission. The proposed tree removals are located on the western perimeter of the two properties next to the enclosure that rests between the property line(see Fig. 1 of Exhibit 1). The subject trees are in close proxiinity to one another. Descriptions of the proposed reinovals on the 10261 Bubb Road properiy are as follows: � Tree#2519A:Pinus cana��iensis(Canary Island pine)is fifteen(15)inches diaineter at fifty- four(54) inches above grade. It is approxiinately thirty (30) feet in height and twenty(20) feet wide. • Tree#2519B: Pinus canariensis (Canary Island pine) is twenty-two(22) inches diameter at fifty-four (54) inches above grade. It is approximately forty (40) feet in height and thirty (30) feet wide. Description of the proposed removal on the 10351 Bubb Road property is as follows: � Tree #2519: Pinus cana�-iensis (Canary Island pine) is twenty-two (22) inches diameter at fifty-four (54) inches above grade. It is approximately forty (40) feet in height and thirty (30) feet wide. The trees listed above are recoininended for removal in part because they are located next to the enclosure that is proposed to be converted to an outdoor patio. The trees are also dainaging the hardscape froin the invasive root systems. The trees will require reinoval so that the patio can be installed. Moreover,they continually shed cones that dainage vehicles parking below thein. The trees listed above are considered protected pursuant to Section 14.18.035 of the City of Cupertino's Municipal Code and require a permit from the City's Planning Departinent prior to their removal. To mitigate the removals, we propose to replace with three (3) 36-inch box trees as replaceinent for the three (3) proposed reinovals pursuant to Section 14.18.185C of the City of Cupertino's Municipal Code. The proposed replaceinents are of the following species and quantity.
