The application is approved with the following conditions: 1. APPROVED PROTECT This approval is based on the application prepared by Rex Tsu, consisting of four pages including a justification statement, photos, a tree removal site plan, and a tree replacement site plan, dated February 10, 2015 and July 17, 2015. 2. TREE REPLACEMENTS The applicant is required to plant one (1) thirty-six (36) inch box Magnolia grandiflora tree in accordance with the approved tree replacement plan. Modifications to the tree species and location may be made to the approved replacement plan pending staff approval. The replacement trees shall be planted prior to the expiration of this dead tree removal permit. 3. PROTECTED TREE COVENANT The property owner shall record a covenant on this property to inform future property owners of the tree protection requirements consistent with this approval and the Protected Tree Ordinance 14.18. Proof of recordation must be submitted to the Community Development Department. 4. PROTECTED TREES The applicant understands that replacement trees may not be removed without a Tree Removal Permit and that they shall be responsible for ensuring the proper maintenance and care of the tree. The applicant shall also disclose the location and species of all replacements trees on site upon sale of the property. 5. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exaction, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Staff has made the findings necessary to grant the tree removal permit in accordance with Section 14.18.180 (A)(1) of the Protected Trees Ordinance. This permit shall expire one year from the date of this letter, on July 28, 2016. Also, please note that an appeal of this decision can be made within 14 calendar days from the date of this letter. If this happens, you will be notified of a public hearing, which will be scheduled before the Planning Commission. As the trunks were fallen in middle of the street, luckily, no one was hurt and no damages caused to the oncoming cars. There is another big trunk which is barely attached to the tree could be fallen down in next storm or earlier by gusty wind. All members of the Homeowners' Association have agreed, for the sake of safety, to remove this tree to avoid damage to the properties and injury to the pedestrians.
