Staff has made the finding that the protected trees are a detriment to the subject property and cannot be adequately supported according to good urban forestry prac#ices due to the overplanting or overcrowding of trees on the subject property.The proposed replacement plan is consistent with the Protected Tree Ordinance since the applicant is replacing the trees on site, and the number of . replacements is consistent with the ordinance. The finding is necessary to grant the tree removal permit in accordance with section 14.1S.1S0 (A) (3). , The application is approved with the following conditions: 1. APPROVED PROLECT � This approval is based on the arborist report prepared by Brent Wahlberg (#WE-3276A), dated November 20, 2015, consisting of one page and a tree removal site plan, except as may be amended by conditions in this resolution. , 2. TREE REPLACEMENT The required replacement trees are one 36-inch box or two 24-inch box Pittosporum Tunifolium for each tree proposed for removal,per the Protected tree Ordinance. The applicant shall provide the Department of Coinmunity Development adequate documentation, including but not limited to photographs,receipts, or invoices, to verify that the replacement trees have been planted within 60 days of replanting. 3. PROTECTED TREES . The applicant understands that replacement trees are protected trees and may not be removed without a Tree Removal Permit and that they shall be responsible for ensuring the proper maintenance and care of the trees. The applicant shall also disclose the location and species of all replacements trees on site upon sale of the property. 4. NOTICE OF FEES DEDICATIONS. RESERVATIONS OR OTHER EXACTIONS The conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exaction, pursuant to Govemment Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. They are growing in a raised planter at the back of the property. The trees appear to be healthy with no.apparent disease or insect problems. They range in height from 60 to 75 feet tall with trunk diameters from 13 to 22.5. inches. These trees have cones that can range from 4 to 9 inches long. The planter is 40 inches high, 42 inches wide (back of wall to the fence in back of the trees) and 32 feet long. The wall is made of cinder block cemented together. The wall is starting to show signs of cracking and looks like it is starting to be pushed out at the top. There are a number of roots visible growing against the top of the wall. If the trees are not removed there will be more damage to the wall with a possibility of it breaking in places. I don't think building a new wall farther away is practical as it takes away from the outdoor living space that the patio provides. In addition the falling cones make it hazardous for children to play in the patio area. I believe that these trees were a bad choice for this location (wrong tree in the wrong place). My recommendation would be to remove the trees and replace with a tree species more suitable to the available area. There are several Pittosporum species that would be good choices for that space. I would also suggest a 1 to 1 replacement ratio because of.the limited space available. S incerely; Brent D. Wahlberg I.S.A.
