Miller requested that the City Council reconsider its decision under the provisions of Section 2.08.096 of the City's municipal code; and WHEREAS, the City Council has considered all relevant evidence presented by the parties at all hearings, including evidence presented at the june 21, 2016 . reconsideration hearing. The petitioners' Reconsideration Petition is defective on its face in that it does not offer proof of facts as required by Municipal Code Section 2.08.096. 2. The petitioners did not provide new relevant evidence which, in the exercise of reasonable diligence, could not have been produced at any earlier city hearing (Municipal Code �2.08.096 (B) (1)). 3. The petitioners have failed to demonstrate that the City Council abused its discretion by not proceeding in a manner required by law; rendering a decision which was not supported by findings of fact; and/or rendering a decision in which the findings of fact were not supported by the evidence (Municipal Code � 2.08.096 (B) (5)). 7. Specifically, the City Council determines that: a. The City Council's decision is supported by findings of fact attached as Exhibit A. b. The findings of fact related to the City Council's decision were supported by substantial evidence in the record of proceedings. 8. AI'PROVED PROJECT This approval is based on a plan set entitled, "New Residence 21900 Oakview Lane, Cupertino CA" consisting of eleven sheets Iabeled "A.1 to A.10 and a topographic survey", dated "Received January 6, 2016" except as may be amended by conditions in this resolution. 2. AIVNOTATION OF THE COlVDITIONS OF APPIZOVAL 'I`he conditions of approval set forth shall be incorporated into and annotated on the building plans. 3. ACCURACY OF THE PROTECT PLANS The applicant/property owner is responsible to verify all pertinent property data including but not limited to property boundary locations, building setbacks, property size, building square footage, any relevant easernents and/or construction records. Any misrepresentation of any property data may invalidate this approval and may require additional review. 4. The project construction plans shall address these requirements with the construction permit submittal, ancl all required improvements shall be completed to the satisfaction of the Director of I'ublic Works prior to final occupancy. 5. GEOTECHIVICAL PLAN REVIEW The applicant's geotechnical consultant shall inspect, test, and approve all geotechnical aspects of the development plans to ensure that their recommendations have been incorporated. The Geotechnical Plan Review should be submitted to the City for review by the City staff prior to issuance of permits. 6. GEOTECI�NICAL,CONSTRUCTION INSPECTIONS The applicant's geotechnical consultant shall inspect, test (as needed), and approve all geotechnical aspects of the project construction. The inspections shall include, but not necessarily be limited to: site preparation and grading, site surface and subsurface drainage improvements and excavations for foundations and retaining walls prior to the placement of steel and concrete. The following shall specifically be performed: The applicant's geotechnical consultant shall inspect all foundation excavations to ensure that the subsurface conditions are as anticipated, and that footings are embedded sufficiently into competent earth materials. 'I'he results of these inspections and the as-built conditions of the project shall be described by the geotechnical consultant in a letter and submitted to the City Engineer for review prior to final project approvaL 7. PItNACY PLANTING The neighbors on the east side stated they will waive the privacy iree requirement in order to gain sun exposure to their property, therefore those privacy plantings are not indicatecl on the plans. Prior to building permit issuance, the applicant shall submit the waiver and the final privacy-planting plan (of all required privacy planting) for review and approval from the Planning I�ivision. The variety, size, and planting distance shall be consistent with the City's requirements. 8. PIZIVACY PROTECTION COVENAlVT The property owner shall record a covenant on this property to inform future property owners of the privacy protection measures and tree protection requirements consistent with the R-1 Ordinance, for all windows with views into neighboring yarcls and a sill height that is 5 feet or less from the second story finished floor. INI�E1ViNIFICATION Except as otherwise prohibited by law, the applicant shall indemnify and hold harmless the City, its City Council, and its officers, employees and agents (collectively, the "indeirulified parties") from and against any claim, action, or proceeding brought by a third party against one or more of the indexnnified parties or one or more of the indemnified parties and the applicant to attack, set aside, or void this Resolution or any permit or approval authorized hereby for the project, including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in defense of the litigation. The applicant shall pay such attorneys' fees and costs within 30 days following receipt of invoices from City. In addition to staff outreach,the property owner also met with these neighbors to try to address their concerns.As a potential solution to the concerns discussed at the meetings,the property owner made the following changes to the plans: � Replaced two previously proposed openable second story windows along the western property line with fixed,obscured windows, and � Removed eight existing Italian Cypresses(Cupressus sempervirens) along the eastern property line(neighbor agreed to sign a privacy waiver for the trees that were required as privacy protection in order to benefit from the additional daylight). During the comment period for the permits, staff received supplemental letters from two of the three neighbors,who previously commented,reiterating their concerns and highlighting their general objection to the construction of a two-story residence. The proposed project is within the parameters of single-family residence approvals.Therefore staff has determined that the proposed project is in compliance with the provisions of Chapter 19.28.140 (A) and 19.28.140(B) of the Cupertino Municipal Code, and no additional conditions of approval were required in order to address the comments raised during the noticing period.. Staff has made all the findings that are required for approval of a 'Two-Story Permit and 1Vlinor Residential Permit as required by Cupertino's Municipal Code, Chapter 19.28.140 (A) and(B). 1. 'The project is consistent with the Cupertino General Plan, any applicable specific plans,zoning ordinances and the purposes of this title. The proposed project is consistent with the General Plan as the project is within the Low Density land use area. There are no applicable specific plans that affect the project. The project has been found to be consistent with the requirements of Cupertino Municipal Code Chapter 19.28 Single Family (R-1) Residential.
