AUTHORIZING EXECUTION OF RELEASE OF DEFERRED AGREEMENT
BETWEEN THE CITY OF CUPERTINO AND MARIO BARBIERI ET AL. ;
NORTHWEST CORNER OF STEVENS CREEK BOULEVARD AND VISTA
DRIVE

WHEREAS, the City of Cupertino and Mario Barbieri and Rita Barbieri
and Vittore A. Barbieri and Annamaria Barbieri entered into an agreement
on March 5, 1973, for the deferred municipal improvement of property
located at the northwest corner of Stevens Creek Boulevard and Vista
Drive; and
•
WHEREAS, the aforementioned agreement is now superseded by an agreement
entered into by the City and the current developer of the property, thus
releiving the Barbieris of any obligation.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are
hereby authorized to execute a "Release of Deferred Agreement" relieving
the Barbieris of the obligations of that certain deferred agreement entered
into on March 5, 1973, and recorded in the County Recorder at Book 0900,
' .Pages 290-304, May 16, 1974.
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized to
have the aforementioned "Release of Deferred Agreement" recorded together
with a copy of this resolution.
PASSED AND ADOPTED at a regular meeting of the City Council of the
City of Cupertino this 19th day of April , 1982 by the following
vote:
