CALIFORNIA LAND CONSERVATION ACT OF 1965 ' mm -! •w
Pursuant to the California Land Conservation Act of 1965, the undersigned
Dorothy Cornelius, City Clerk of the City of Cupertino does hereby give
notice of cancellation of the following described Contracts thereunder and
certifies:
•
1. The County of Santa Clara and Dorothy Lyddon heretofore entered into
Land Conservation Contracts under the California Land Conservation Act of 1965;
a copy of such Contracts was recorded on February 29, 1968 in Book 8041, pages
251-275 of the Official Records of the County of Santa Clara, State of California,
covering all land hereinafter described.
2. Said area is now in the City of Cupertino.
3. By and upon adoption of Resolution No. 6156 of the Council of the
City of Cupertino, adopted September 6, 1983 subject to the conditions therein
set forth such contracts were cancelled.
4. The amount of cancellation fees certified by the Council of the City
of Cupertino in said Resolution as being due pursuant to Sections 51283 and
51283.1 of the Government Code of the State of California are $331,014.
5. There are no contingencies of waivers or deferment of )payments• except
the following:
Full payment before Cancellations Effective. City Council Resolution
No. 6156 cancelling said contracts specifically provided that payment in full
of the cancellation fees of $331,014 was required of Dorothy Lyddon as owner,
prior to the cancellations therein becoming effective, and that until such payment
in full had been made the cancellation of the Contracts shall not be effective,
notwithstanding the tentative approval to cancellations therein given; unless '
fees are paid or a certificate of cancellation of contracts is issued within one
year from the date of the recording of the certificate of tentative cancellation,
such fees, shall be recomputed as of the date of notice described in subdivision (b):
of Section 51283.4.
6. Permits. All permits necessary to commence the project shall be obtained.
7. Notification. The landowner shall notify the Council when s/he has
' satisfied the conditions and contingencies relating to the tentative cancellations.
Within 30 days of receipt of such notice and upon determination that conditions
and contingencies have been satisfied, the Council shall executesa certificate
of cancellation of contracts and cause-'the same to be recorded.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO-
CERTIFYING TO THE COUNTY AUDITOR OF SANTA CLARA COUNTY
THE AMOUNT OF CANCELLATION FEES TO BE PAID UPON CANCELLA-
TION OF LAND CONSERVATION CONTRACTS , GIVING TENTATIVE
APPROVAL TO SUCH CANCELLATIONS PRESCRIBING CONDITIONS
UPON WHICH THIS RESOLUTION WILL BE EFFECTIVE, DIRECTING
THE CLERK TO RECORD A CERTIFICATE RELATING TO SUCH CAN-
CELLATION FEES WHEN RESOLUTION IS EFFECTIVE, REQUIRING
PAYMENT IN FULL OF CANCELLATION FEES PRIOR TO THE CANCEL-
LATIONS BECOMING EFFECTIVE; AND PRESCRIBING OTHER CONDI- .
TIONS IN CONNECTION THEREWITH
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CUPERTINO:
Pursuant to the California Land Conservation Act of 1965, this Council
hereby finds and determines;
1. Dorothy Lyddon as landowner of the hereinafter described lands has
filed petitions with the Council for cancellation of Land Conservation Contracts
heretofore entered into with the County of Santa Clara and recorded February' 29,
1968 in Book 8041, Pages 251-275 of Official Records of the Recorder of the County
of Santa Clara, State of California.
2. The land described in said petitions and Contracts is all that real property
now in the City of Cupertino, County of Santa Clara, State of California, which is
described on Exhibit "A" attached hereto and hereby incorporated into this resolution,
said land is located within an agricultural preserve.
3. The City Clerk has caused notice of a public hearing in said petitions to
be given and published in the manner and within the time required by law.
4. This Council, at the time and place mentioned in such notice or to which the
hearing shall have been continued, has held a public hearing on such petitions and any
protest of such cancellation and has received oral and documentary thereof.
5. Upon action of the Council herein giving tentative approval herein to cancella-
tion of said Contracts, the County Assessor of the County of Santa Clara certified to
this Council that the cancellation valuation of the land described in said petitions
for the purpose of determining cancellation fee is $2,251,889 (Two million, two hundred
fifty one thousand, eight hundred eighty nine dollars) .

NOW, THERFORE, pursuant to said Land Conservation Act of 1965: H 901PISE 15
A. The Council determines and certifies to the County Auditor of the County of
Santa Clara, State of California, that the amount the landowner Dorothy Lyddon
• must pay as deferred taxes upon cancellation of the afore said Contracts is
$331,014.
B. The Council hereby determines that the cancellation of the Land Conservation ,
Contracts is not inconsistent with the purposes of the California• Land Conserva-
tion Act of 1965, cancellation and alternate use will notresult in discontinguous
patterns of urban development and are consistent with the General Plan of Oct. 1,198
C. By reason of the foregoing this Council hereby gives tentative approval to the
cancellation of these Contracts, subject to the following conditions:
• Pursuant to Government Code Section 51283.3 (a) this Council
hereby requires payment in full of the cancellation fees of
$331,014 from Dorothy Lyddon as landowner, prior to the cancella-
tions herein becoming effective and until such payment in full is
made, the cancellation of such contracts shall not be effective;
and further, in the event such cancellation fees are not paid with-
in 365 days from the date this Resolution is adopted the provisions
of this Resolution and the tentative approval to cancellations shall
be null and void in their entirety and such petitions shall thereupon
be deemed denied by this Council without prejudice.
D. The City Clerk is hereby directed to record the certificate and notice of
cancellations provided in Government Code Section 51283.3.
E. Upon payment of the cancellation fees herein provided the City Clerk shall
record with the County Recorder, pursuant to law, a written certificate of
the release of the •lien of such cancellations.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO . MAKING
CERTAIN FINDINGS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY
ACT IN CONNECTION WITH THE CANCELLATION OF A WILLIAMSON ACT
CONTRACT RELATING TO REAL PROPERTY AND CERTIFYING REVIEW AND
CONSIDERATION OF THE ENVIRONMENTAL IMPACT REPORT THEREOF

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CUPERTINO:
WHEREAS, the Council intends to approve the cancellation of Williamson
Act Contracts relating to real property described on the attached Exhibit "A"
(hereinafter "territory") which Contracts were recorded February 29, 1968
in Book 8041, pages 251-275 of Official Records of the Recorder of the County
of Santa Clara, State of California, and
WHEREAS, the California Environmental Quality Act of 1970, as amended
(CEQA) , requires that in the approval of a project for which an Environmental
Impact Report has been prepared, the decision making body must review said
Report, and
WHEREAS, •.the project for such territory was the subject for an Environmental
Impact Report recommended for preparation by the Environmental Review Committee
and reviewed and considered by the Planning Commission and City Council,
NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby:
1. Identify the Project that is mentioned in this resolution as the
cancellation of Williamson Act Contracts and disestablishing the
Agricultural Preserves which relate to real property described on
the attached Exhibit "A".
2. Declares that significant environmental effects of the cancellation
of the contracts and the carrying out of said project in its approval
form have been identified in the Environmental Impact Report and have
been mitigated by the plan changes and conditions of approval stated
in Resolution No. 5870 (Exhibit "B" attached) .
PASSED AND ADOPTED at a regular meeting of the City Council of the City
of Cupertino this 6rh day of _Sp.,tember , 1983, by the following

IMPACT REPORT: INTERI,AND DEVELOPMENT COMPANY,. "SEVEN
SPRINGS RANCH DEVELOPMENT"

WHEREAS, the I.nterland Development Company proposes to construct a •
419-unit residential planned development located on 148 acres at the north- -
west corner of the intersection of Prospect Road and Stelling Road ("Seven •
Springs Ranch") ; and
WHEREAS, the City of Cupertino has prepared and submitted an Environmental
Impact Report for review by the decisionmaking body pertaining to the project;
and
WHEREAS, the final Environmental Impact Report was reviewed in conjunction
with the public hearings for. prezoning Application 25-Z-80; and
WHEREAS., the significant environmental effects of the project identified
in the Environmental Impact Report have been mitigated by the following plan
changes and development conditions of approval. •
SIGNIFICANT EFFECT MITIGATLON MEASURE
A. Traffic and Circulation Condition No. 17 of Planning Commission
Resolution 2303 requires the applicant
to participate in a proportionate share
of major off-site street improvements of '
a local and communitywide nature. It. IA
further stipulated that at the use permit
and building permit stages, phasing will
be determined in conjunction with mitigation
measures consistent with the adopted General
Plan. The site plan is to be modified , as
required by Condition 18 of Planning
Commission Resolution 2303, regarding on-
site circulation and its effect on neighboring
residential streets. Additional access to
the property is • requir.ed. Interior
• . circulation modifications will be required
to discourage vehicular traffic cutting
through the project to existing residential
streets. Additionally, the applicant shall
• provide a detailed traffic control plan for
Rainbow Drive between Bubb Road and Southern
Pacific Railroad crossing to reduce vehicular
volumes and speeds and discourage penetration
into existing neighborhoods. - As provided
by Condition Na. 22, public access is being
assured. to the Fremont Older Open Space
District property at the present terminus
of Upland Way.

B. Noise • A number of noise mitigations will be
• required as a part of the development to
maintain an acceptable noise environment
for project residents. These measures
will include sound insulation, berms,
noise harriers, distant setbacks, etc.
Construction noise will be restricted to
normal working hours with equipment muffled.
in accordance with health and safety standards.

WHEREAS, the following significant environmental effects of .the project
identified in the -Environmental Impact Report cannot be mitigated, a statement '
of overriding considerations based upon information of record and the Final
Environmental Impact Report are set forth below.
SIGNIFICANT EFFECT OVERRIDING CONSIDERATIONS
A. Noise Project generated traffic will not increase
ambient noise levels on adjacent streets in
a perceivable manner with exception of
Prospect Road west of Stelling Road. This
roadway would increase by 4 decibels to a
community noise equivalent level of 51 to
55 decibels which• is consistent with the •
conditionally "acceptable level" within
. ,the adopted City General Plan. •
B. Conversion of Agricultural Project entails the conversion of approxi-
Use mately 80 acres of agricultural use to
urban uses. Information of record suhmilted
as part of the Environmental Impact Report
• demonstrates the economic, non-viability
of the existing agricultural use.
• Additionally, it is proposed to maintain
community agricultural uses such as vegetable
gardens and product. iv'e fruit trees as part
of the' open space and landscaped areas. Due
Lo. the size of the agricultural use and its
• relation to surrounding urban uses,, it has
been deemed that the production of needed
housing for the community outweighs the
continued uneconomic use of agriculture.
NoW, THEREFORE, i•t is hereby found, determined and ordered that the City
t Coon( dl of the .City of Cupertino, as responsible agency, has considered said
Environmental Impact Report- and hereby certifies. that it has reviewed. 'ml r•enside.red
the 'information contained therein and that the Environmental lmpacl Repoli. has
been completed incompliance with the CEQA and State guidelines. Council finds
• further that alterations have been incorporated into the project which mitigate
or avoid each significant environmental impact identified in the Environmental
• Impact Report to an acceptable level as defined in Section 8.7 of the Cupertino
Environmental Guidelines. Council further resolves that the Director of Planning
mid Development is to file a Notice of Determination as required. under the •
California Environmental Quality Act .

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
APPROVING LOT LINE ADJUSTMENT BETWEEN TWO PARCELS OF LAND
WITHOUT A PARCEL MAP IN ACCORDANCE WITH SECTION 66412 (d)
OF SUBDIVISION MAP ACT AS AMENDED JANAURY 1, 1984
APN 366-9-30, PROPERTY OF DOROTHY LYDDON RAINBOW DRIVE
AND STELLING ROAD
WHEREAS, there has been submitted to the staff a request for a lot
line adjustment of property recorded as APN 366-9-30 by Dorothy Lyddon
Rainbow Drive and Stelling Road and more particularly described in attached
Exhibit "A" and "B"; and
WHEREAS, said adjustment will affect properties recorded as APN:
366-4-3

366-4-16
366-9-32
366-9-33
WHEREAS, in accordance with Section 66412(d) of the Subdivision Map Act
this adjustment may be made without filing a parcel map;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Cupertino hereby approved the aforementioned lot line adjustment and exempts
it from the requirements of the parcel map.

Parcel No. 2 in the Deed to Dorothy Anne Lyddon, recorded March 26, 1964 under
Recorder's File No. 2598586 .in Book 6439 of Official Records, page 178, Santa Clara
County Records and being more particularly described as follows:
BEGINNING at the Southwesterly corner of said right-of-way and strip of land, said corner.
also being the Southeasterly corner of Parcel No. 1 described in said Deed to Lyddon;
thence from said point of beginning along the Northwesterly line of said right-of-way being
